Damages $2000, and make the same returnable at the next term of the Shelby Circuit Court.

            You are hereby commanded to summon  Anderson Winterrowd,  William P. Winterrowd,  James Smith  and  Jacob Winterrowd  and  James Bone,  John C. Maze  &  Robert Titus,  William Walker,  William E. Bone  to personally be and appear before the Judges of the Shelby Circuit Court, on Thursday the fourth day of the next term, to be begun and held at the Court House, in Shelbyville on the Second Monday in April 1853 then and there to testify on behalf of the defendant in a certain suit pending in said Court, wherein James H. State of Indiana In the Circuit Court of Shelby County
Shelby County Sct                                              . April Term A.D. 1853

            The Plaintiff James Hendrickson complains of Peter J. McCain of a plea of Trespass on the Case:  For that whereas the defendant contriving and wrongfully intending to injure the Plaintiff heretofore, towit, in the first day of August 1852, at the county of Shelby and State of Indiana and on divers days and times between that day and the commencing of this suit debauched and carnally knew the Plaintiffs daughter & Servant Mary Hendrickson, and who then and there and during all the time aforesaid was and yet is the Servant of the Plaintiff, and whereby the said Mary Hendrickson became pregnant and sick with child and so continued for a long time, towit, for the space of many months at said county by means of which the said Mary Hendrickson was unable and do and perform the necessary business and affairs of the Plaintiff being her Father and Master aforesaid, for a long time, towit, from the said first day of August 1852 to the commencement of this suit and during all which time the Plaintiff hath lost & been deprived of the service of the said Mary Hendrickson, and by reason of the premises the Plaintiff necessarily incurred great expense towit, the sum of $100 dollars and about the nursing and taking care of the said Mary Hendrickson and many other grievances and troubles incidental thereto, towit, at the County of Shelby and State of Indiana and to the damage of the Plaintiff $2000.  Two Thousand dollars, Hence he sues &c.
