Lease from
Joseph Drake
This Indenture made the first day of October in the Year of Our Lord Eighteen
hundred and forty four between Joseph Drake of Shelby County and State of
Indiana of the one part and Stephen Rogers and Daniel
Shew of Bartholomew County and State aforesaid of the other part
The said Joseph Drake agrees to rent his grist mill and lot of ground known as
his mill lot which his son Hiram now lives on on Flatrock
River with all the appurtenances thereunto belonging with the full privilige of
useing all of the water for grinding or other wise when it fails to run over the
Dam and all they may see fit to use when it runs over said dam
Said Joseph Drake is to build a new dam across said River for the use of said
mill in the course of one year or there abouts for the use of said mill and keep
it in good repair unto untoo [?] Stephen Rogers and Daniel Shew for the
term of seven years from the first day of next January for the sum of one
hundred and twenty five dollars a year which they are to pay or cause the same
to be paid y their heirs or assigns quarterly and the first quarters rent in
advance on the first day of January next and so on allternately during the term
of Seven years and they are to move off the old mill house at their expense and
finish the same build a new one thirty two by forty feet square or their
abouts and build a new for bay at least two new water-wheels with gears and
fixtures for the same all nessesary elevators Rolling screen and
cooler or hopper boy all to be done in a good workmanlike manner
Said mill house is to be one and a half story high and to be well finished also
a run of four feet burr stone and Irons for same for one hundred Dollars which
they are to be paid for out of the last seven years rent by said Joseph Drakes
furnishing them with Boards Shingle rafters weather boarding
Studding Joist flooring plank for forebay and timber for the same and all
other sawed lumber for the use of completing said mill which they are to keep in
repair and at the expiration of said seven years they are to leave the mill in
good repair and running order for which we severally bind ourselves and our
heirs and assigns for the full and complete performance of the within made
Indenture for which we severally affix our seals and names in presence of
