                                                Comes now  James H. Duncan,  Maria J. Smith,  Albert A. Duncan,  Lora F. Barr,  Margaret A. Allen,  Andrew J. Duncan, Jr.,  Martha V. Brown,  Pressie Bentley,  America Andis,  Missouri Anderson,  Rezin Duncan,  June M. Colclazier,  Henry C. Duncan,  Elzy Duncan,  Floyd Duncan,  Clara Duncan,  Walter Duncan, Stella Duncan,  Lora Duncan,  and  Edna Duncan,  as heirs and distributees in said estate, and show to the court that the estate of said Mary C. Drake, deceased, was fully and finally settled on the 28th day of March, 1905, except as to the distribution of the funds of said estate; that the said funds belonging to said estate, except as to $63.40 paid to  Sarah C. Ridlin, was paid by the said administrator to the Clerk of the Shelby Circuit Court, Shelby County, Indiana, and now is in the hands of said clerk; that no part thereof has been paid to these petitioners or either of them.
            That said decedent died intestate leaving as her only heirs at law her brothers  Henry P. Duncan  and  Samuel Duncan, her sister,  Sarah C. Ridlin, the petitioners, Henry C. Duncan, Rezin Duncan, Martha V. Brown, America Andis, June M. Colclazier, Missouri Anderson and Pressie Bentley, children and only heirs of  Albert Duncan, a deceased brother of said Mary C. Drake; the petitioners James H. Duncan, Margaret A. Allen, Mariah J. Smith, Lola F. Barr [note:  spelled 'Lora' above], Albert A. Duncan, Andrew J. Duncan, Jr., children of  Andrew Duncan, and  Elzy Duncan, Floyd Duncan, Clara Duncan, Walter Duncan, Stella Duncan, Lora Duncan, and Edna Duncan, children of  William O. Duncan, deceased, and grand-children of said Andrew Duncan, a deceased brother of said Mary D. Drake; the heirs of  James R. Duncan, a deceased brother of said Mary C. Drake; and the heirs of  Mariah Ridlin, a deceased sister of said Mary C. Drake.
            Petitioners show that said Henry P. Duncan was indebted to the estate in the sum of $236.29, evidenced by a note dated April 1, 1889, together with interest thereon; that said administrator settled said note by accepting payment of the face thereof in money and the execution to him by said Henry P. Duncan of a receipt in full for said Duncan's distributive share in said estate; that therefore said Henry P. Duncan has no interest in said funds so paid for distribution to said Clerk.
            Petitioners further show that said Samuel Duncan is indebted to said estate in the sum of $224.35, now unpaid, that said sum of $224.35 in largely in excess of said Samuel Duncan's distributive share in said estate; that by reason of such indebtedness the said Samuel Duncan has no interest in the distribution of said funds so paid to said Clerk.
            Petitioners further show that said administrator 
paid to the said Sarah C. Ridlin, as part of her distributive share of said estate the sum of  . . . . . .  $ 63.40

            Wherefore said petitioners pray that, upon the payment of the costs of this petition, the Clerk of said court be authorized and directed to pay to said petitioners out of the funds for distribution belonging to said estate and now in his hands, the several amounts to which they and each of them are entitled as in this peition above set out.
