            The within named commissioners personally appeared before me the undersigned, a justice of the peace in and for said county and being each duly sworn, do each depose and say that he will faithfully and impartially discharge his duties as such commissioner, according to the best of his skill and judgement.

Petition  for  Assignment  of  Dower

Samuel F. R. Hill  &  Julia Ann Hill
                    VS
Abraham Hill,  William Hill,  Mary Ann Hill,  Abigail J. Hill  and  Sarah Hill

            Now come the said petitioners and file their petition herein which reads in the words and figures to wit (here insert it) and William VanBenthusen the Guardian of said Defendants who are all infants comes also and enters an appearance hereto and files his answer herein which reads in the words and figures following to wit (here insert it) and this cause being submitted to the Court upon said petition and the answer aforesaid and the premises being seen and fully inspected.  It is ordered adjudged and decreed by the Court that said petitioners have their Dower set off and assigned to them of in and to the real estate of the said  Isaac Hill  dec’d as set forth and described in said petition to wit ninety acres off of the North side of the North West quarter of section twenty two, Township eleven North of Range six East and thereupon the Court appoint Joshua B. Lucas, Thomas Claton and Thomas Cochran as commissioners of this Court to assign and set over to the said Samuel F. R. Hill and Julia Ann Hill his wife in right of the said Julia Ann, their Dower of in and to the land and premises aforesaid and of their proceedings herein, they are required to make report at the next term of this Court until which time this cause is continued.
            We, the undersigned Commissioners appointed by an order of the Shelby Probate Court to assign and set over to Julia Ann Hill, her dower in the lands and tenements of her late husband Isaac Hill deceased, in said order named, do respectfully report that having been first duly sworn according to law, we did proceed to perform that duty; and we do assign and set over to the said Julia Ann for her dower aforesaid, the following lands, to wit beginning at the North East corner of said quarter and running thence South Thirty one (31) poles to a Stone-thence West eighty nine (89) poles to a Stone to a county road running through said quarter, thence West of South a long said road Seventeen (17) poles to a Stone-thence West Sixteen (16) poles to a Stone-thence West fifty two (52) poles to a Stone on the Section line-thence North on said Section line twenty six (26) poles to the North West corner of said quarter and thence East on the Section line one hundred and Sixty (160) poles to the North East corner of said quarter to the place of beginning, estimated to contain thirty one (31) acres be the same more or less.
            Witness our hands & Seals, this 16th day of June A.D. 1847

To the Honorable the Judge of the Shelby Probate Court in the State of Indiana

            The petition of Samuel F. R. Hill and Julyann Hill his wife respectfully showeth that on or about the ____ day of April 1845 Isaac Hill late of the county of Shelby & State of Indiana and now deceased departed this life leaving your petitioner Julyann Hill his widow him surviving and  five children to wit  Abraham Hill,  William Hill,  Mary Ann Hill,  Abagail Jane Hill  &  Sarah Hill who are all the heirs and legal representouous of said decedent and who are all Minors under the age of twenty one years and that William VanBenthusen of said County was by your honorable Court duly appointed Guardian of said wards and all of said heirs reside in said County excepting William Hill who resides in the State of Ohio.  And that the said Isaac Hill deceased was before and at the time of his death seized in fee simple of and in the following lands situate in said County to wit Ninety acres off of the North side of the North West quarter of section twenty two Township eleven North of Range Six East And that said petitioner Julyann Hill is entitled to and claims dower in all of said lands as the widow of said Isaac Hill deceased.  And your petitioner would further represent that since the death of the said Isaac Hill deceased your petitioners have intermarried Therefore & in consideration of the premises would your honor appoint proper persons Commissioners to assign and set over to your petitioner Julyann Hill her dower in the lands aforesaid.  And your petitioner will ever pray.

Note from Linda Read Chesser:  I have  Isaac Hill  as a son of  Abraham and Sarah (Hawkins) Hill  and  Samuel
FitzRandolph Hill
as a son of  James and Mary (FitzRandolph) Hill.  Abraham
and James were brothers, sons of  William and Mary Hill.  So Isaac and Samuel
were first cousins, according to my records.
