The undersigned appointed to appraise the undivided one half of the West half of the South West quarter of Section thirty four in Township thirteen North of  Range Seven East situate in the county of Shelby and State of Indiana and subject to the Dower estate of  Jane Seaman  therein, it being the property of  John M. Seaman,  James H. Seaman,  and  Amelia Ann Seaman  minor heirs of  Joseph Seaman  deceased having been duly sworn report that after due examination of the premises, we are of the opinion that the said property is worth $600.00 subject to the right of dower aforesaid.

            Know  all  men  by  these  Presents, That we,  William Hacker   Zachariah B. Waller   and   William Brown   of Shelby County, Indiana, are held and firmly bound unto the State of Indiana, in the sum of twelve hundred dollars, lawful money, to the payment whereof well and truly to be made, we bin ourselves, our heirs, executors and administrators, jointly and severally, firmly by these presents, sealed with out seals, and dated this tenth day of June 1853.
          The condition of the above obligation is such, that whereas the above bounden   William Hacker   as guardian of   John M. Seaman   James H. Seamon  &  Amelia Ann Seaman   minor heirs of Joseph Seaman   late of said County, deceased, has filed in the Common Pleas of Court of said County his petition to sell certain real estate, belinging to his said wards.  Now should the said William Hacker as such guardian faithfully discharge his trusts according to law, in the sale of said real estate, and in the management, disposition and application of, and faithful accounting for, the proceeds of such sale, provided a sale thereof shall be ordered by said Court, then the above obligation to be void, otherwise to be and remain in full force and virtue in law.

Friday   June 17th   1853

Matter of the application of  William Hacker  Guardian of  John M Seman[sic]   James H. Seaman  and  Amelia Ann Seaman  for sale of real Estate. ~~~
Now comes the said Guardian
and files the report of the said appraisers herein, which reads in the words and figures following to wit (here insert it.)  and said Guardian also files an additional bond herein in the sum of twelve hundred dollars with Zachariah B. Waller and William Brown as securities which is approved of by the Court and reads as follows (here insert it)  and the premises being seen and fully inspected it is ordered adjudged and decreed by the Court that said Guardian be and he is hereby ordered and fully authorized and empowered to sell either at public or private sale as he may think most to the advantage of his said wards the said tracts and parcel of land described in said petition and appraisment towit.  the undivided one half of the West half of the South West quarter of Section thirty four in Township thirteen North of  Range seven East  in siad County of Shelby.  subject to the right of Dower of  Jane Seaman  therein.  And he is ordered to sell the same on a credit of six months with interest from date taking from the purchaser note with good security collectable withou any relief from valuation or appraisment laws.  And of his proceedings he is required to make report to this court at the next term thereof until which time this cause is continued.

          To the Judge of the Court of Common pleas of Shelby County Indiana.
          William Hacker  who is the Guardian of  John M. Seaman,  James H. Seaman,  and  Amelia Ann Seaman  minor heirs of  Joseph Seaman  decd would report to your Honor that in pursuance of the order of your said Court made at the June Term thereof for the year 1853.  he did on the 10th day of December instant sell to  George W. Fleming  at private Sale the land described in Said order, to wit, the undivided one half of the West half of the South West quarter of Section 34 in Township 13 North  of Range 7 East  for the price and sum of six hundred dollars, subject to the right of dower of  Jane Seaman  therein, that being the highest and best price which could be had therefor and the full appriased value thereof, that he has taken the Said Fleming's note for Said purchase money with good surety th ? , and with interest from the day of sale and due and payable on the 25th day of December 1853.  waiving valuation laws -- which Sale he prays may be confirmed.

          To the honorable the Judge of said Court Your petitioner William Hacker, who is Guardian of the persons and estates of  John M. Seaman   James H, Seaman   and  Amelia Ann Seaman  would represent and show unto your honor that  Joseph Seaman  late of said county deceased was the owner in fee simple of the following described real estate, to wit, the West half of the South West Quarter of Section thirty four in Township thirteen North  of Range seven East  containing forty acres more or less and being so the owner thereof died intestate  And your petitioner further shows that after the death of said  Joseph Seaman  the administrator of his estate under an order of the Probate court of said County sold said West half of the East half of the South West Quarter of Section thirty four in Township thirteen North  of Range seven East  for the purpose of paying the debts of said decedent.  That  Jane Seaman  the widow of said decedent after his death -- applied to the Probate Court of said county to have her dower in all of said lands assigned to her -- and upon said application commissioners were appointed by said Court. who assigned and set apart as her said dower Thirty five acres off of the West side of said West half of the South West Quarter of Section thirty four in Township thirteen North  of Range Seven East,   Your petitioner further shows that said West ahlf of the South West Quarter of Section thirty four in Township thirteen North of Range seven East containing eight acres more or lefs decended to George W- Seaman,  John, M, Seaman,  James, H, Seaman --- Amelia, Ann, Seaman,  Clarissa, F- Hite, wife of -- James W. Hite,  and  Mary. E. Cooper  wife of -- James R. Cooper.  as said decedents heirs at low subject to said right of dower as aforesaid, -- Your petitioner further shows that his said wards have includsive of all of their personal property the sum of eighty six dollars and sixty eight cents in money, which is drawing six percent interest   And that they have no personal estate dependant upon the settlement of any estate or the execution of any turst   Your petitioner further shows that his said wards recieve no annual profits from their real estate or if any the same are applied to the payment of taxes on their said estate, and are insufficient or the same   Your petitioner further shows that his said wards are minors within the age of twenty one years, to wit   Said  John M. Seaman  is about the agoe of 14 years.  said  James H. Seaman  is about the age of 11 years and said  Amelia, Ann- Seaman  is about the age of 9 years and said wards are residing with their Mother in the County aforesaid   Your petitioner would further represent that the estate of his said wards may at this time be sold on good terms.  and the proceeds arising there-from invested in other real estate or some good par[?] stock to the decided advancement and benefit of said -- wards.  Your petitioner therefore asks that there may be suitable persons appointed to apprais[sic] the estate of said wards, it being the  undivided half of the West half  of the South West Quarter  of section thirty-four  in Township thirteen North  of Range seven East  continaing eight acres more or lefs Subject to the widows right of dower as aforesaid  Your petitioner further asks for an order of your said Court. authorizing him to sell said land at private sale on such terms as to your honor may seem proper  And direct such reinvestment or idsposition of the proceeds arising from said sale as to your honor may seem most for the benefit of said wards

Seaman,  and  Amelia Ann Seaman, minor heirs of  Joseph Seaman  deceased, by the Court of Common Pleas of Said County, and they are to report their appraisement at the present Term of Court.  the witness whereof I have hereunto set my hand the 8th day of June 1853.
