          NOW  at this time come the said  Casandra Boon,  Peter F. Kennedy  and  Miranda Kennedy, by  Thomas A. Hendricks,  their solicitor, and suggest to the court the death of  Joseph J. Boon,  one of the complainants herein since the commencement of this cause, and ask leave of the Court to revive the same in the names of  William J. Boon,  Peter F. Kennedy,  Miranda Kennedy,  Casandra Boon,  Amos St. Clair,  Mariam St. Clair,  Coleman F. Storm,  Rebecca J. Storm,  Benjamin H. Boon,  David Boon,  by  Alexander Miller  his next friend, and  Apolos Kinsley,  administrator of the estate of said  Jooseph J. Boon,  deceased, which leave was granted by the court, and thereupon said complainants file their bill of Revivor herein.  It is therefore ordered by the court that said non-resident defendants, towit,  James M. Fleming,  Enock M. Fleming,  Benjamin G. Fleming, John Q. Fleming,  Elijah Lemaster  and  Benjamin Lemaster,  be notified fo the filing of said bill or revivor and the pendency of this cause, by publican in the  'Volunteer'  a weekly newspaper of general circulation, according to the statute in such case made and provided--And that unless they be and appear before the Judges of our said Shelby Circuit Court on the first day of the next term thereof to be holden at the Court house in Shelbyville on the third Monday of February 1848, and then and there plead answer or demur to the said original bill of complaint and said Bill of Revivor, the matters and things therein contained will be taken as confessed and true by and against them and will be heard and determined in their absence and decreed upon accordingly,

            Be it remembered that on this 25th day of February 1848 personally came into open court  Thomas A Hendricks  who being duly sworn says that the notice hereto annexed was published in the Volunteer a weekly newspaper of general circulation printed & published in the Town of Shelbyville in Shelby County State of Indiana for three successive weeks - to wit - on the tenth - seventeenth and twenty fourth days of September in the year Eighteen hundred and forty Seven ---
