Shelby County ss                        March term 1869

                    Alfred L. Pollitt  and  Cynthia Pollitt  his wife, Eliza J. Pollitt  by the said  Alfred L. Pollitt  her guardian, Jane Rhodes  and  Mary E. Rhodes  complain of Alonzo Blair and show to the court that on the 9th day of March 1862 the Estate of John B. Rhodes late of said county and then deceased, was duly settled in said court, and upon such settlement there was afterwards found to be for distribution among the heirs of the said  John B. Rhodes  dec after the payment of all debts and costs the sum of three hundred and twenty two and 60/100 dollars, that the decedent left him serving as his only heirs at law  Eliza J. Pollitt,  Jane Rhodes,  Cynthia Pollitt,  Mary E Rhodes and  Daniel Rhodes.  That there was then and paid to the said Eliza J. Pollitt, Jane Rhodes, Cynthia Pollitt and Mary E. Rhodes each the sum of sixty-four and 52/100 dollars as their full shares of said Estate upon such distribution, and there was then and there paid into the hands of the said Alonzo Blair, who was then the Clerk of said Court for the said Daniel Rhodes the sum of sixty-four dollars and fifty-two cents, and who still continues to hold said sum.  They further show that the said Daniel Rhodes on or about the day of July 1858, being then about 16 years of age, left his home in said county and went to parts unknown and has not since that time returned to his home or been heard of or his place of residence or being ascertained, although dilligent enquiry has been made for him and he is now presumed to be dead, that he left him surviving as his only heirs at law the said Eliza J. Pollitt, Jane Rhodes, Cynthia Pollitt and Mary E. Rhodes and there are no debts existing against him the said Daniel Rhodes.  They therefore ask the court to hear their proofs touching the aforesaid matters, and to order the said sum of $64.52 to be paid over to the said Eliza J. Pollitt, Jane Rhodes, Cynthia Pollitt and Mary E. Rhodes as being entitled thereto, as such heirs at law.

                            Be it remembered that on this day William H. Pollitt came personally before me the undersigned Clerk of the Court of Common Pleas of said County and being duly sworn says that some ten years ago Daniel Rhodes, one of the children and heirs at law of John B. Rhodes deceased, being then about 16 years of age, left his home in said County and went to parts unknown, and has not returned to said County or been heard of by any person, so far as known to said affiant, and is now believed by his friends and relations to be dead, and further says not.

On this day Alfred L. Pollitt came personally before me the undersigned Clerk of the Court of Common Pleas of said county and being by me duly sworn says that he was the Administrator of the Estate of John B. Rhodes deceased, who was his father in law, that he settled said Estate in the Court of Common Pleas of said County on or about the 9th day of March 1862, that the said John B. Rhodes died about the (blank) day of August 1855.  That David Rhodes who was a son of said John B. Rhodes and one of his heirs at law, left his home in said County on or about the (blank) day of July 1858 being then about sixteen years old, and went to parts unknown, and has not since that time been heard from, that he said affiant has made dilligent enquiry for said David and can find nothing of him or to which part of the country he went to, and that no person, so far as he can learn, has seen or heard of the said David since he thus left his home, and he is now believed to be dead and further says not.
