Alice  M. Phillips



                    I,  Alice M. Philips  make this my last will and testament.
1.  It is my will that all my just debts, funeral expenses and cost of administration be first paid.

2.  All the residue of my property I will and devise and bequeath to  Edward E. Colee  in fee simple and absolutely.

3.  I have left my husband nothing for the reasons but know to myself and of which I do not care to state in this will.

4.  I nominate and appoint  Kendall M. Hord  as Executor of this will to inforce the provisions thereof. August 8th 1913.

Signed by the above named Alice M. Philips and acknowledged to be her last will and testament and signed by us as attesting witnesses in her presence at her request and in the presence of each other. August 8th 1913.

                                        Be it remembered, That on the 10th day of December, 1915 Will A. Webb one of the subscribing witnesses to the within and foregoing last Will and Testament of Alice M. Phillips late of said County, deceased, personally appeared before the Circuit Court of Shelby County, in the State of Indiana, and being duly sworn by the Clerk of said Court upon his oath, declared and testified as follows, that is to say: That on the 8th day of August, 1913 he saw the said Alice M. Phillips sign her name to the said instrument in writing as and for her last Will and Testament; and that this deponent, at the same time, heard the said Alice M. Phillips declare the said instrument in writing to be her last Will and Testament, and that the said instrument in writing was at the same time, at the request of the said Alice M. Phillips and with her consent attested and subscribed by the said Will A. Webb and Bessie Moreilion in the presence of said testatrix and in the presence of said Will A. Webb and Bessie Moreilion and each of them and in the presence of each other as subscribing witnesses thereto, and that the said Alice M. Phillips was, at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age (that is, more that twenty-one years of age), and of sound and disposing, mind and memory, and not under any coercion or restraint as the said deponent verily believes, and further deponent says not.

                    I, Cecil B. Collins Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the within annexed Will and Testament of Alice M. Phillips has been duly admitted to probate, and duly proved by the testimony of Will A. Webb one of the subscribing witnesses thereto, that a complete record of said Will, and of the testimony of the said Will A. Webb in proof thereof, has been by me duly made and recorded in Book 7 at Pages 82 & 83 of the record of Wills of said County.

                    In Attestation Thereof, I have hereunto subscribed my name, and affixed the seal of said Court, at Shelbyville, this 10th day of December, 1915.

In Re-Estate of                                                            Election by Daniel Phillips to take under the Law.
Alice M. Phillips, deceased

                    Comes now Daniel Phillips and represents and shows that at the time of the death of Alice M. Phillips he was and for many years prior thereto had been her husband. That at the said decedent departed this life on the 5th day of December, 1915, duly probated in the Shelby Circuit Court in said County and that the same is recorded in Will Record 7 page 82 of the Records of said County.
                    That said Daniel Phillips hereby renounces the provisions of said decedents will as to himself and hereby elects to take the interest in her said estate that is given to him under the laws of descent, of the State of Indiana. He further represents that he has read and examined the said will of said decedent, and that he is familiar with all of its provisions.
