Last  Will  and  Testament
of

Alta  J. Gregory



I,  Alta J. Gregory,  of Shelby County, Indiana, do hereby make, publish and declare this to be my last will and testament, hereby revoking all former wills made by me.

Item 1.  I give and bequeath to my husband,  Ira J. Gregory,  all of my personal estate which shall remain after payment of my debts and expenses of administration, the same to be his absolutely.

Item 2.  I give and devise to my said husband, Ira J. Gregory, all the real estate of which I may die seized of, to be held by him for and during the term of his natural life and for that term only, this devise to be in lieu of all his rights and interest in my said real estate under the laws of descent of this state.

Item 3.  I give and devise the remainder in fee of all the real estate which I may own at my death, subject to the life estate of my said husband provided for in item two above, to my children  Merl J. Gregory,  Mary V. Gregory,  and  Lotha M. Gregory, to be held by them in fee simple in equal shares, and in case any child or children shall be born to me hereafter, such child or children shall share equally any said real estate with the children above named.

Item 4.  I hereby nominate and appoint my said husband, Ira J. Gregory as executor of this will.

In witness whereof, I have hereunto set my hand and seal this 11th day of October, 1909.

The foregoing instrument was signed, sealed and acknowledged by Alta J. Gregory as and for her last will and testament, in our presence, who at her request in her presence and in the presence of each other, subscribe our names as witnesses thereto, on this 11th day of October, 1909.

Be it remembered that on the 9th day of December A. D., 1919, the 55th judicial day of the November Term of the Shelby Circuit Court in said year, come into open Court Ira J. Gregory and produces in Court an instrument in writing purporting to be the last Will and Testament of Alta J. Gregory, deceased, and now moves the admittance thereof to probate and record, and in proof of said will introduces Wilbur W. Israel one of the subscribing witnesses thereto, who being duly sworn by the Clerk of said Court, on oath, declare and testify as follows, that is to say: That on the 11th day of October 1909 he saw the said Alta J. Gregory sign her name to said instrument in writing as and for her last will and testament and that this deponent, at the same time, heard the said Alta J. Gregory declare the said instrument in writing to be her last will and testament, and that the said instrument in writing was, at the same time, at the request of the said Alta J. Gregory and with her consent attested and subscribed by the said Wilbur W. Israel and William H. Isley in the presence of said testator and in the presence of each other, as subscribing witnesses thereto, and that the said Alta J. Gregory was, at the same time of the signing and subscribing of said instrument in writing as aforesaid, of full age (that is, more than twenty one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint, as the said deponent verily believes, and further deponent says not

Whereupon it is ordered, adjudged and decreed by the Court that said instrument in writing purporting to be the last Will of Alta J. Gregory deceased, is the last will and testament of said Alta J. Gregory, deceased, and is hereby admitted to probate and record in this Court.

I, Gordon Thurston, Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the within annexed Will and Testament of Alta J. Gregory has been duly admitted to probate, and duly proved by the testimony of Wilbur W. Israel one of the subscribing witnesses thereto, that a complete record of said will, and of the testimony of the said Wilbur W. Israel in proof thereof, has been by me duly made and recorded in Book 7 at pages 448 and 449 of the record of wills of said County. In attestation whereof, I have hereunto subscribed my name, and affixed the seal of said Court, at Shelbyville, Indiana, this 9th day of December 1919.
