17 April 1894


I,  Ann Fisher  of Shelby County, State of Indiana, do make this my last Will as follows, to-wit: ~

Item 1st.          It is my desire that all my debts shall be paid as soon as possible after my death.

Item 2nd.          After the payment of my debts if any, I will and bequeath to my husband Francis Fisher the one third part of my real estate and the same to be taken in full of any and all right claim or interest which he may have in my estate.

Item 3rd.          All the residue of my estate both real and person, I will and bequeath to my son Wool C. Fisher absolutely.

Item 4th.          I appoint my husband Francis Fisher as executor of this my Will.

          We certify that the above named Ann Fisher did sign the above instrument in our presence and in our presence did declare the same to be her last Will and that we did each sign our names as witnesses in the presence of said Ann Fisher and in the presence of each other this 17th day of April 1894.

          Be It Remembered, That on the 26 day of August 1912, Charles W. Culbertson one of the subscribing witnesses to the within and foregoing last Will and Testament of Ann Fisher late of said County, deceased, personally appeared

before the Clerk of the Circuit Court of Shelby County in the State of Indiana and being duly sworn by the Clerk of said Court upon his oath, declared and testified as follows, that is to say, That on the 17th day of April 1894 ~ he said the said Ann Fisher sign her name to the said instrument in writing as and for her last Will and Testament and the this deponent, at the same time, heard the said Ann Fisher declare the said instrument in writing to be her last Will and Testament and that the said instrument in writing was at the same time, at the request of the said Ann Fisher and with her consent attested and subscribed by the said Charles W. Culbertson and Charles Major in the presence of said testatrix and in the presence of each other, as subscribing witnesses thereto, and that the said Ann Fisher was at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age (that is more than twenty one years of age) andof sound and disposing mind and memory and not under any coercion or restraint as the said deponent verily believes and further deponent says not.

Culbertson one of the subscribing witnesses thereto that a complete

record of said Will and of the testimony of the said Charles W. Culbertson in proof thereof has been by me duly made and recorded in Book 6 at pages 179 - 180 - 181 of the record of Wills of said County.
