I, August Brummer of Shelby County and State of Indiana, being of sound mind and disposing memory, do hereby make and declare this my last Will and Testament hereby revoking and making void all former Wills by me at any time heretofore made.

Item 1.  I hereby direct that all my just debts and funeral expenses be paid out of the first moneys coming into the hands of my Executor and Executrix.

Item 2.  I hereby direct that my Executor and Executrix hereinafter named erect at my grave a suitable monument not to exceed in cost the sum of Three Hundred Dollars. 

Item 3.  I hereby devise to my daughters Emma Albright  and  Anna Schuler the following tract of land towit:  Commencing at the North East corner of my land in the East half of the North East quarter of Section 31 in Township 13 North of Range 7 East, thence running due West One Hundred (100) feet; thence South East in an angle a sufficient distance to contain one acre and to a point 25 feet distance from the East line of said land: thence East to the East line of said land thence North to the place of beginning.  This one acre of land is to be used by my said children Emma and Anna for the purpose of procuring dirt to make fills on other lands herein devised to said children, and I hereby direct that no dirt or gravel be sold from the said tract to persons outside the family.

Item 4.  I hereby devise to my daughter Emma Albright  3 and 1\2 acres off of the entire North end of the following described land: Beginning at a point 9 38/100 chains South of the North East Corner of the East half of the North East quarter of Section 31 in Township 13 North of Range 7 East; Running thence South 14 94/100 chains to a corner stone; thence West 495/100 chains to the Center of the Michigan Road; thence North 21 3/4 West along the Center of said Road 16 chains and 8 1/2 links to a point 10 and 28/100 chains South East from the North line of said Tract measured on said road; thence East 10 80/100 chains to the place of beginning. This strip in Item 3 of this Will to be first be taken off of the whole tract before the 3 1/2 acres herein described is taken off of the North End of the remainder.

Item 5.  I hereby devise to my daughter Anna Schuler Three (3) acres of land immediately South of and adjoining the tract of land willed to my daughter Emma Albright, in Item 4 of this Will extending from the Center of the Michigan Road to the West line of the One acre tract devised in Item 3 of this Will.

Item 6.  I hereby devise to my wife Regena Brummer for and during her natural life all the residue and balance of my Real Estate consisting of about 4 6/21 acres of land in the North end of the East half of the North East quarter of Section 31 in Township 13 North of Range 7 East in Addison Township Shelby County, Indiana. The remainder in fee of said real Estate, which I have devised to my wife for life and I will and devise to my son Charles Brummer.

Item 7.  I hereby bequeath to my wife Regena Brummer, my automobile for and during the period of her natural life, in order that she may enjoy the use of the same during her life time. That she shall take care of said machine and keep the same in good condition, and at her death, it is my Will that the ownership of said Automobile shall be vested in my son Charles Brummer.

Item 8.  I hereby will and bequeath to my wife Regena Brummer Two Thousand Dollars out of any personal property now owned by me, I also will her all the household goods, live stock and implements. The said $2000.00 to be in addition to the household goods, live stock and implements.

Item 9.  The interest and income on all notes and mortgages I may own at the time of my death, after deducting bequeath heretofore made, and the interest and income on any renewals of mortgages paid off, I hereby bequeath to my wife Regena Brummer.

Item 10.  All notes and mortgages I may own at the time of my death (which have not already been bequeathed by this Will) I bequeath to my children, Charles Brummer, Emma Albright and Anna Schuler, share and share alike except the income on the same which shall go to my wife during her natural life time as provided in Item 9 of this Will and I hereby appoint my wife Regena Brummer Trustee to hold said notes and mortgages and to loan and reloan the same during her life time, and I hereby direct her not to loan over 75% of the Value of land and improvements and not to loan any money on City property. 

Item 11.  I hereby nominate and appoint my son Charles Brummer and my wife Regena Brummer Executor and Executrix of this my last Will and Testament and I hereby request that R. W. Harrison be employed as attorney to assist my Executor and Executrix in the settlement of said Estate.

          The above foregoing instrument was at the date thereof signed published and declared by the said August Brummer as and for his last Will and Testament, and as a revocation of all former Wills heretofore made by him in the presence of us who at his request and in his presence and in the presence of each other have susbscribed our names as witnesses.

          Be it remembered that on the 3rd day of March A.D. 1913 the 25" Judicial day of the February Term of the Shelby Circuit Court in said year come into open Court  Robert W. Harrison and produces in Court an instrument in writing purporting to be the last Will and Testament of August Brummer deceased and now moves the admittance thereof to probate and record and in proof of said Will introduced  Robert W. Harrison one of the subscribing witnesses thereto who being duly sworn by the Clerk of said Court on oath declares and testifys as follows, that is to say.  That on the lst day of April 1912 he saw the said August Brummer sign his name to said instrument in writing as and for his last Will and Testament; That this deponent at the same time, heard the said August Brummer declare the said instrument in writing to be his last Will and Testament and that the said instrument in writing was at the same time at the request of the said August Brummer and with his consent attested and subscribed by the said  Ed Deitzer and  Robert W. Harrison in the presence of said testator and in the presence of each other as subscribing witnesses thereto, and that the said August Brummer was at the time of the signing and subscribing of said instrument in writing as aforesaid of age (that is more than twenty one years of age) and of sound and disposing mind and memory and not under any coercion or restraint as the said deponent verily believes, and further deponent says not.

          Whereupon it is ordered adjudged and decreed by the Court that said instrument in writing purporting to be the last Will of August Brummer deceased is the last Will and Testament of August Brummer deceased and is hereby admitted to probate and record in this Court.

Coyle Clerk of the Circuit Court of Shelby County, Indiana do hereby certify that the within annexed Will and Testament of August Brummer has been duly admitted to probate and duly proved by the testimony of Robert W. Harrison one of the subscribing witnesses thereto that a complete record of said Will and of the Testimony of the said Robert W. Harrison in proof thereof has been by me duly made and recorded in Book 6 at pages 274-275-276-277 and 278 of the record of Wills of said County.
          In Attestation Whereof I have hereunto subscribed my name and affixed the seal of said Court at Shelbyville, Indiana this 3rd day of March 1913.

Renunciation of Letters of Executorship

In the Shelby Circuit Court February Term 1913 In the
Matter of the Estate of August Brummer deceased 

          The undersigned, Regena Brummer herewith shows that in a certain paper purporting to be the last Will and Testament of August Brummer, deceased who died at the County aforesaid, the same being his last place of residence on the 26" day of February 1913 she was appointed and nominated Executrix thereof.
          She hereby declines to accept such executorship, and renounces all right to exercise the Office of Executrix of said Will. She further states that she has not inter meddled with the effects of said testator since his decease nor in any manner acted as Executrix of said Will.

ELECTION OF WIDOW OF AUGUST BRUMMER

In the Shelby Circuit Court February Term - 1913 

In the Matter of the Estate of August Brummer deceased Election by Widow.
Whereas my late husband August Brummer, deceased, late of the County of Shelby and State of Indiana, in and by his last Will and Testament probated in said County provided as follows.


Item 6.  I hereby devise to my wife Regena Brummer for and during her natural life all the residue and balance of my real estate consisting of about 4 1/2 acres of land in the North end of the West half of the North East quarter of Section 31 in Township 13 North of Range 7 East, in Addison Township, Shelby County, Indiana. The remainder in fee of said real estate which I have devised to my wife for life I will and devise to my son Charles Brummer.

Item 7.  I hereby bequeath to my wife Regena Brummer my automobule for and during the period of her natural life, in order that she may enjoy the use of the same during her life time. That she shall take care of said machine and keep the same in good condition and at her death, it is my will that the ownership of said machine shall be vested in my son Charles Brunner.

Item 8.  I hereby will and bequeath to my wife Regena Brummer Two Thousand Dollars out of my personal property now owned by me. I also will her all the household goods, live stock and implements. The said $2000.00 to be in addition to the household goods, live stock and implements.

Item 9.  The interest and income on all notes and mortgages I may own at the time of my death, after deducting bequests or on any money reloaned from mortgages paid off, I hereby bequeath to-my wife Regena Brummer.

          Now therefore I  Regena Brummer  in consideration thereof now hereby elect to accept said provisions so made for me in said Will in full satisfaction of my interest in and right to 1/3 of the lands and personal property of which my late husband aforesaid died seized and in lieu of my Statutory rights and by these presents  I do release, renounce and discharge all my right and claim to such interest as is given me by law in and to all said real estate and personal property.
