Last  Will  and  Testament
of
Catharine  Howery


February 17th 1860

Catharine Howry  of Van Buren Township County of Shelby State of Indiana, do make and publish this my last will and testament, hereby revoking and making void all former wills by me at any time heretofore made.  First, I direct that my body be decently interred, and that my funeral be conducted in a manner corresponding with my estate and situation in life; and as to such worldly estate as it has pleased God to intrust me with, I dispose of the same in the following manner to wit:  I direct, first that all my just debts and funeral expenses be paid as soon after my decease as possible out of the first moneys that shall come to the hands of my executors from any portion of my personal estate.  I also direct that a fair valulation or appraisement be made by three judicious neighbors; of all my said estate including my household furniture and after being signed with their names, that a copy of the same be given by them to my exceutor or executors.  I Give to my beloved son  Charles Howry  a Beadstead, bed and Beding, To my beloved Son  John Howry  one Bedstead, bed and Beding, To my beloved Son  Samuel Howry,  I give a Beadstead, bed and beding, also a saddle worth Ten Dollars or instead of a saddle Ten Dollars in cash.  Also to my beloved Son  Jacob Howry  I give and bequeath one Bedstead Bed and Beding also a Saddle worth Ten Dollars or Ten Dollars in cash.  I also give and bequeath to my beloved Daughter  Sarah.J. Howry  one Beadstead Bed and Beding also my Saddle that I have had in use, I further direct that all my other estate be sold at auction and given to my heirs equal share and share alike.

In witness whereof I Katharine Howrey the Testatrix have hereunto set my hand and seal this seventeenth day of February in the year of our Lord Eighteen hundred and Sixty.

Whereas I Catharine Howrey of Shelby County in the state of Indiana having made and duly executed my last will and testament in writng bearing date the seventeenth day of February in the year Eighteen hundred and Sixty.  Now I do hereby declare this present writing to be a codicil to the said will and direct the same to be annext thereto.  And I hereby make and ordain my worthy and esteemed friend Jacob Howrey executor of this my last will and and testament. And in case I shall leave my son Jacob Howrey living at the time of my decease I hereby direct and appoint my esteemed friend Jacob Howrey shall have the tuition and guardianship of him during his minority.  And earnestly entreat the utmost care and attention respectively in and about the education and morals of my said son.

In witness whereof I Catharine Howrey the testatrix have here unto set my hand and seal this the ninteenth day of Fe[b]ruary in the year of our Lord Eighteen hundred and Sixty.

I Johathan Copple swear that I was present and witnessed the execution of the last will and testament of Catharine Howry Deceased who departed this life on the     day of February a.d. 1860 at the County of Shelby and State of Indiana, that the name of said decedent was signed by me in her said decedents presence and by her request and that is was also signed attested and subscribed besides in my own presence in the presence of one  Jorden Perry  John Jackson  whose name apears annexed whereto besides in the presence of the said decedent, that said decedent at the time of signing the same was of sound mind and was in evry respect competent to deivise her said property, and that she signed the same without any coercion whatever - but with her own free will and accord.
