Last Will

Francis  Fisher

Know all men by these Presents that I  Francis Fisher  of Shelby County Indiana, being of sound mind and disposing memory, do make, publish and declare this to be my last Will and testament hereby revoking any and all others by me at any time heretofore made.

First:   ~   I direct that all my just debts and funeral expenses be paid by my executor hereinafter named.

Second.   ~   All the rest and residue of my property; whether real or personal, I give, devise and bequeath to my son, Wool C. Fisher, to be his absolutely and in fee simple.

Third.   ~   I hereby nominate my son Wool C. Fisher to be executor of this will and direct that he shall not be required to give any bond.

          In Witness Whereof, I have hereunto set my hand and seal, this third day of Jan - 1910.

          We hereby certify that we saw Francis Fisher the above named testator sign the foregoing will and that he declared it to be his last Will and Testament and we, at his request and in his presence and in the presence of each other, signed the same as witnesses this third day of January 1910.

          Be It Remembered, That on this ~ ~ ~ day of August 1912, H. S. Downey one of the subscribing witnesses to the within and foregoing last Will and Testament of Francis Fisher late of said County deceased, personally appeared before the Clerk of the Circuit Court of Shelby County in the State of Indiana, and being duly sworn by the Clerk of said Court, upon his oath,

declared and testified as follows, that is to-wit: That on the 3rd day of January 1910 he saw the said Francis Fisher sign his name to the said instrument in writing as and for his last Will and Testament; and that this deponent at the same time heard the said Francis Fisher declare the said instrument in writing to be his last Will and Testament and that the said instrument in writing was, at the same time, at the request of the said Francis Fisher and with his consent attested and subscribed by the said H. S. Downey and Edith M. Davis in the presence of said testator and in the presence of each other as subscribing witnesses thereto and that the said Francis Fisher was at the time of the signing and subscribing of said instrument in writing, as aforesaid of full age (that is more than twenty one years of age) and of sound and disposing mind and memory and not under any coercion or restraint as the said deponent verily believes and further deponent says not.

S. Downey one of the subscribing witnesses thereto that a complete record of said Will and of the testimony of the said H. S. Downey in proof thereof has been by me duly made and recorded in Book 6 at pages 182 - 183 - 184 of the
