Last Will

George  Kinsley

I,  George Kinsley,  being of lawful age and of sound mind and memory do make and publish this my last Will and Testament.

Item 1.   It is my will and I direct after my death all my Just debts and funeral expenses shall be first paid out of my Estate.

Item 2.  After the payment of my just debts and funeral expenses as provided in item 1, I then will, devise and bequeath to my several children - Viz:  Laura D. Hendricks,  Nora B. Kinsley,  Eva May Means,  Lillie G. Able,  Nellie A. James,  Maude E. Copper,  H. Glenn Kinsley  and  Eliza L. Kinsley all my property real personal or mixed, share and share alike.  Should any of my said children be dead at the date of my decease, leaving a child or children surviving then in that Event the child or children of such deceased child shall take the share given to the parent and which the parent would have taken if living.
Should any one or more of my said children die, without issue before my death then in that event the surviving brother and Sisters shall take the share of the deceased in equal proportions.

Item 3.  If Eliza L. Kinsley my minor child shall not be 21 years old at my death then it is my wish and will that this my last Will, be not probated until my said child shall arrive at the age of 21 years, or until Dec 5th 1910, unless before that time she shall have married a man over 21 years of age.

Item 4.  I have made no provisioins in this Will for my beloved wife  Sarah C. Kinsley , because she is duly provided for in an antenuptial contract made and entered into by us.

Item 5.  I hereby revoke any and all former Wills by me made.

Executor of this my last Will and testament my son H. Glenn Kinsley.

Signed by George Kinsley as his last Will and testament in our presence and by each of us as witnesses in his presence and in the presence of each other at his instance and request this 16 day of October 1909.

          Be it remembered, that on the 27 day of June A.D. 1912, the     judicial day of the May Term of the Shelby Circuit Court in said year came into open Court H. Glenn Kinsley and produces in Court an instrument in writing purporting to be the last Will and testament of George Kinsley deceased and now moves the admittance thereof to probate and record and in proof of said Will introduces David L. Wilson one of the subscribing witnesses thereto, who being duly sworn by the Clerk of said Court on oath, declare and testify as follows, that is to say: That on the 16th day of October 1909 he saw the said George Kinsley sign his name to said instrument in writing as and for his last Will and Testament and that this deponent at the same time heard the said George Kinsley declare the said instrument in writing to be his last Will and Testament and that the said instrument in writing was at the same time, at the request of the said George Kinsley and with his consent, attested and subscribed by the said David L. Wilson by the style of D. L. Wilson and S. J. Thompson in the presence of said testator, and in the presence of each other

as subscribing witnesses thereto, and that the said George Kinsley was at the time of the signing and subscribing of said instrument in writing, as aforesaid of full age (that is more than twenty one years of age) and of sound and disposing mind and memory and not under any coercion or restraint as the said deponent verily believes, and further deponent says not.

Whereupon it is ordered, adjudged and decreed by the Court that said instrument in writing purporting to be the last Will of George Kinsley deceased is the last Will and Testament of George Kinsley deceased and is hereby admitted to probate and record in this Court.

          I, Otto L. Coyle, Clerk of the Circuit Court of Shelby County, Ind. do hereby certify that the within annexed Will and Testament of George Kinsley has been duly admitted to probate and duly proved by the testimony of David L. Wilson one of the subscribing witnesses thereto, that a complete record of said Will and of the testimony of the said David L. Wilson in proof thereof, has been by me duly made and recorded in Book No. 6 pages 154 - 155 - 156 of the record of Wills of said County.

In Attestation Whereof, I have hereunto subscribed my name and affixed the seal of said Court at Shelbyville, Ind. this 5th day of July 1912.
