Last Will and Testament
of

Mary Hughes

I,  Mary Hughes,  at this time a resident of the City of Shelbyville, in Shelby County, State of Indiana, make this my last will and testament, hereby revoking all other wills or testamentary papers by me at any time heretofore made.

Item 1.  I will that all my just debts shall be paid out of my personal estate, if there be enough thereof so to do, if not, then the real estate mentioned in item two (2) shall be made subject to such debts in so far as it may be necessary to liquidate the same.

Item 2.  I give and bequeath to married daughter, Bessie M. Rice, all that part of Lot Number One (1) on Harrison Street in Samuel Hamilton's Addition to the town (now City) of Shelbyville, in Shelby County, Indiana, described as follows: the East half of that part thereof which is included within the following boundaries towit:  Beginning at a point one hundred and eighty two (182) feet East of the North West corner of said lot and running thence East four (4) rods, thence South eleven (11) rods, thence West Four (4) rods, and thence North eleven (11) rods to the place of beginning.

Item 3.  I bequeath and devise to my beloved daughter, Bessie M. Rice, for and during her natural life, only, all of the following described real estate situate in Shelby County, Indiana, towit:  The West half of the South East Quarter of Section Four (4) in Township Eleven (11) North, and Range Six (6) East, containing Eighty (80) acres more or less, and the remainder in fee simple of said real estate, I bequeath and devise to my children of my said daughter, who shall be living at the time of her death, or if any such children should be dead, to their descendants, and if no such children or their descendants be living at the time of the death of my said daughter, Bessie M. Rice, then I bequeath and will said last described real estate to my heirs at law.

Item 4.  I give and devise to my daughter Bessie M. Rice, all the personal estate of which I may die seized, subject to the payment of my just debts as set out in item 1 above.

Item 5.  I hereby nominate and appoint my daughter Bessie M. Rice as Executrix of this my last will and testament.

In testimony whereof, I, Mary Hughes, have have hereunto set my hand this 7th day of March, 1914.

Signed by testatrix, Mary Hughes, as her last will, in the presence of us, who, at her request, in her presence, and in the presence of each other, have hereunto subscribed our names as witnesses, this 7th day of March 1914.

State of Indiana, Shelby County, SS:
          Be it remembered, that on the 13th day of March, A.D., 1916 the 1st judicial day of the March Term of the Shelby Circuit Court in said year, came into open Court O. L. Williams and produces in Court an instrument in writing purporting to be the last Will and Testament of Mary Hughes, deceased, and now moves the admittance thereof to probate and record, and in proof of said Will introduces, Julius L. Showers, one of the subscribing witnesses thereto, who being duly sworn by the Clerk of said Court, on oath, declare and testify as follows, that is to say: That on the 7th of March, 1914 he saw the said Mary Hughes sign her name to said instrument in writing as and for her last Will and Testament; and that this deponent at the same time, heard the said Mary Hughes declare the said instrument in writing to be her last Will and Testament, and that the said instrument in writing was, at the same time, at the request of the said Mary Hughes and with her consent attested and subscribed by the said Julius L. Showers and Isaac N. Cooper in the presence of said testator, and in the presence

of each other, as subscribing witnesses thereto, and that the said Mary Hughes was, at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age (that is, more than twenty-one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint as the said deponent verily believes, and further deponent says not.

Where upon it is ordered, adjudged and decreed by the Court that said instrument in writing purporting to be the last will of Mary Hughes deceased, is the last Will and Testament of Mary Hughes deceased, and is hereby admitted to probate and record in this Court.

State of Indiana, Shelby County, SS:
          I, Cecil B. Collins Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the within annexed Will and Tesament of Mary Hughes has been duly admitted to probate, and duly proved by the testimony of Julius L. Showers one of the subscribing witnesses thereto, that a complete record of said Will, and of the testimony of the said Julius L. Showers in proof thereof, has been by me duly made and recorded in Book 7 at Pages 101 & 102 of the record of Wills of said County.

          IN  ATTESTATION  WHEREOF,  I have hereunto subscribed my name, and affixed the seal of said Court, at Shelbyville Indiana, this 13th day of March 1916.
