Last  Will  and  Testament   of
Samuel  C.  Love

          I,  Samuel C. Love, of Shelby County, and State of Indiana, make and publish this my last Will and Testament revoking all former will made by me.

          1.  I will and direct that my Executor herein after named, shall sell and reduce to cash all my real and personal property without any order of Court with authority to sell convey and give good and complete title therefore as fully and completely as I could do, without any order of Court.

          2.  I direct that my said Executor shall pay and discharge all my just debts and obligations, but to resist all my just debts that may be presented against my Estate or my property.

          3.  I direct and will that my said Executor shall erect around the graves where my father, mother, brothers and sisters are buried in the grave-yard in Liberty Township, Shelby County, Indiana a permanent Cement wall to be built upon a gravel basis about 3 1/2 feet high and 18 inches thick so as to make a permanent enclosure of said graves so as to protect them without any openings in said wall, and I charge my said Executor with the exercise of a descretion as to property carrying out this provision in the will.

          4.  After discharging the above obligations with the cost and expense of Administration I will and devise and bequeath to Joseph Mullen who lives with me the sum of $300.00 provided he lives with me until my death in the capacity he is now serving me. In the past I have paid said Mullen for the services in full and shall continue so to do and the above bequest shall be taken and received by said Mullen for all past services and all services he may hereafter render.  If the said Mullen shall file or assert any claim or demand against me or my Estate this bequest shall be null and void, and if he accepts the same he shall execute to my executor a receipt reciting and stating that said sum of money shall be in full of all demands against me and my estate.

          5.  After said executor has sold and conveyed all the real and personal property of which I shall die seized, and paid and discharged all the above obligations above set out any residue remaining.

          I will, devise and bequeath to my nephew, D. K. Love son of my brother John Love who resides in Jasper County in the State of Illinois, the one twelfth (1/12) of said residue, and to my niece Miranda Mitchell, daughter of my sister Elizabeth Mings, formerly Elizabeth Love the seven twelfths of said residue and to my niece Sarah Welsh, daughter of my sister Elizabeth Mings, I will and bequest the four-twelfths (4/12) of said residue.  In making the above bequests to my nephew and two nieces I have fully considered this present financial condition of each, and this desents any my obligations to each with reference to their claims upon me.

          6.  I nominate and appoint  John Hoop of Shelbyville, Indiana the Executor of this will investing him with full authority to execute and carry out the full spirit and interest of this will.

          7.  I will and direct that my remains shall be buried at Forest Hill Cemetery near Shelbyville, Indiana on the lot where my brother Franklin Love is buried, and I direct that the outfit shall be somewhat similar and in keeping with the outfit of my said brother; and I direct that the date of my death shall be inscribed upon the monument now on said lot, which now bears the date of my birth.

          Signed and acknowledged by the above named Samuel C. Love to be his last Will and Testament in our presence, and signed by us as attesting witnesses at his request in his presence and in the presence of each other, February 10th 1911.

          Be it Remembered that on the 22" day of December 1911, Kendall M. Hord one of the subscribing witnesses to the within and foregoing last Will and Testament of Samuel C. Love late of said County, deceased, personally appeared before the Clerk of the Circuit Court of Shelby County, in the State of Indiana, and being duly sworn by the Clerk of said Court upon his oath declared and testified as follows, that is to say: That on the 10th day of February 1911 he saw the said Samuel C. Love sign his name to the said instrument in writing as and for his last Will and Testament; and that this deponent, at the same time heard the said Samuel C. Love declare the said instrument in writing to be his last Will and Testament and that the said instrument in writing was at the same time, at the request of the said Samuel C. Love and with his consent attested and subscribed by the said K.M. Hord and Jacob Haehl in the presence of said testator, and in the presence of each other as subscribing witnesses thereto, and that the said Samuel C. Love was at the time of signing and subscribing of said instrument in writing, as aforesaid, of full age (that is, more than twenty-one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint, as the said deponent verily believes, and further deponent says not.

          I, Otto L. Coyle Clerk of the Circuit Court of Shelby County, Indiana do hereby certify that the within annexed Will and Testament of Samuel C. Love, has been duly admitted to probate, and duly proved by the testimony of Kendall M. Hord, one of the subscribing witnesses thereto, that a complete record of said Will and the testimony of the said Kendall M. Hord in proof thereof has been by me duly made and recorded in Book 6 pages 86-87-88 and 89, of the record of Wills of said County. In Attestation Whereof I have hereunto subscribed my name and affixed the Seal of said Court at Shelbyville this 22nd day of December 1911.
