Last  Will  and  Testament
of
Samuel  Stansifer


          I,  Samuel Stansifer , a resident of Shelby County in the State of Indiana, do hereby make, publish and declare this to be my last Will and testament, hereby revoking any and all other wills by me heretofore made.

          Item 1.  It is my will and I do hereby direct that as soon as possible after my decease all of my just debts and funeral expenses to be paid out of my personal estate.

          Item 2.  After the payment of all of my just debts and funeral expenses, as provided for in item one above, I give, devise and bequeath all of the residue of my personal estate that shall remain to my children  William G. Stansifer,  Alonzo C. Stansifer,  Viola Marlin  and  Florence C. Montgomery,  and to my two grandchildren,  Carrie B. Garrison and Mamie M. Kinsley,  said children and grand-children to take said personal property share and share alike in fee simple.  In the event any of my said children or grand-children shall die before my decease having a child or children surviving, such child or children shall take the share the parent would have taken if living.

          Item 3.  I give devise and bequeath to each of the following of my children and grand child, Viz:  Ulissus G. Stansifer,  Alonzo C. Stansifer,  Viola Marlin,  and  Carrie B. Garrison, the undivided one sixth part in value of all of the real estate of which I shall die seized to have and to hold as their undivided property forever in fee simple.

          I further give, devise and bequeath to my grand-child Mamie M. Kinsley, the rents and profits of the undivided one sixth part in value of all of the real estate of which I may die seized until she shall arrive at the age of twenty-one years then she shall take the fee simple in said one sixth part in value of said real estate,  Provided, that in the event the said Mamie M. Kinsley shall die before arriving at the age of twenty-one years leaving a child or children, then in that event the undivided one sixth part in value of my real estate as above bequeathed to her I devise and bequeath to her child or children so surviving her; and in the event she, the said Mamie M. Kinsley, shall die before arriving at the age of twenty-one years, then and in that event I give, devise and bequeath the said one sixth part in value of my real estate so bequeathed to her to my children and grandchildren or the descendents of such as may be dead, said descendents to take the share the parent should have taken if living.

          I further give, devise and bequeath to my daughter Florence C. Montgomery the undivided one sixth part in value of all the real estate of which I may die seized to have and to hold for and during the term of her natural life, and after her death to her children in fee simple. In event either of my said children or my grand-child Carrie B. Garrison, shall die before my decease leaving a child or children surviving, such child or children so surviving shall take the share the parent would have taken if living.

          Item 4.  I do hereby constitute and appoint my brother Thomas Stansifer as Executor of this my last will and testament.

          In the event my said brother Thomas Stansifer shall be dead at the time of my decease or shall for any reason decline to serve as the executor of this my last will, then and in that event I do hereby constitute and appoint my friend John K. Anderson as the Executor of this my last will and testament.

          In witnesses whereof I have hereunto set my hand and seal this 13th day of April 1910.

          Signed sealed and acknowledged by the said Samuel Stansifer as his last will and testament in our presence, and signed by us as attesting witnesses thereto, at his request, in his presence and in the presence of each other this April 18" 1910.

          Be it remembered That on the 28th day of August 1915 Everet E. Stroup one of the subscribing witnesses to the within and foregoing last Will and Testament of Samuel Stansifer late of said County, deceased, personally appeared before Cecil B. Collins, Clerk of the Circuit Court of Shelby County, in the State of Indiana, and being duly sworn by the Clerk of said Court, upon his oath, declared and testified as follows, that is to say: That on the 13th day of April 1910 he saw the said Samuel Stansifer sign his name to the said instrument in writing as and for his last Will and Testament, and that this deponent, at the same time, heard the said Samuel Stansifer declare the said instrument in writing to be his last Will and Testament, and that the said instrument in writing was at the same time at the request of the said Samuel Stansifer and with his consent attested and subscribed by the said Everet E. Stroup and Charles W. Culbertson in the presence of said testator, and in the presence of each other, as subscribing witnesses thereto, and that the said Samuel Stansifer was at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age (that is, more than twenty-one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint, as the said deponent verily believes, and further deponent says not.

          Sworn to and subscribed by the said Everet E. Stroup before me, Cecil B. Collins Clerk of said Court, at Shelbyville, the 28th day of August 1915.

          I Cecil B. Collins Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the within annexed Will and Testament of Samuel Stansifer has been duly admitted to probate, and duly proved by the testimony of Everet E. Stroup one of the subscribing witnesses thereto, that a complete record of said will, and of the testimony of the said Everet E. Stroup in proof thereof, has been by me duly made and recorded in Book 7 at Pages 42-43-44-45 of the record of Wills of said County.

          In Attestation Whereof, I have hereunto subscribed my name and affixed the seal of said Court, at Shelbyville, this 28th day of August 1915.
