Last  Will  and  Testament  of
Sophia  Cherry

          I  Sophia Cherry make and publish this my last Will and Testament.

Item One.  I direct that my just debts funeral expenses, expense of my last sickness and costs of administration be first paid. 

Item 2.  I will and devise and bequeath to  Ida Cozart Crossman  the home which is my home and residence with the ten (10) acres upon which it is situated and adjoining same for and during the term of her Natural life and at her death in fee simple to her son Earnest Cozart.

Item 3.  I will and bequeath to Irwin Whorter and his wife Margaret $500.00.

Item 4.  I will and bequeath to  Frank R. Cherry  $200.00. 

Item 5.  I will and bequeath to  Hess Ray  the sum of $200.00.

Item 6.  I will and bequeath to Ozark Tribe of the Improved Order of Redmen of Fairland Indiana the sum of $200.00 to be held as a trust fund in perpetuty to be loaned out for the highest and best interest that can be obtained therefore and the Interest shall be used on each decoration day to decorate the graves of my husband my Son, my Sister and my mother.

Item 7.  My fancy clock I will and bequeath to Anna Timney.

Item 8.  My piano I will and bequeath to the Children of Ida Cozart Crossman.

Item 9.  I will and bequeath all of my household goods and effects to Ida Cozart Crossman.

Item 10.  I will and bequeath the diamond Ring that belonged to my Son Thomas A. Cherry to my friend Dr. M. M. Wells

Item 11.  All the residue of my property real and personal of the paying the above bequest I direct that shall be sold for the highest and best price that can be obtained therefore and out of the proceeds my balance remaining or residue remaining I will devise and bequeath to the Methodist Episcopal Church of Fairland Indiana. 

Item 12.  Before said residue shall be paid to said Church I will and bequeath to said Church and direct my Executor hereinafter named to pay said Church the sum of $100.00 to be used without restriction of said Church may desire. 

I hereby nominate and appoint Ed. K. Adams as Executor of the Will confiding in him to carry out and execute the provisions of the Will.

          Be It remembered that on the First day of March A.D. 1913 the 24" judicial day of the February Term of the Shelby Circuit Court in said year, come into open Court Kendall M. Hord and produces in Court an instrument in writing purporting to be the last Will and Testament of Sophia Cherry deceased and now moves the admittance thereof to probate and record and in proof of said Will introduces Kendall M. Hord the subscribing witnesses thereto who being duly sworn by the Clerk of said Court on oath, declare and testify as follows, that is to say, That on the 28" day of January 1913 he saw the said Sophia Cherry sign her name to said instrument in writing as and for her last Will and Testament and that this deponent, at the same time heard the said Sophia Cherry declare the said instrument in writing to be her last Will and Testament and that the said instrument in writing was at the same time at the request of the said Sophia Cherry and with her consent attested and subscribed by the said Kendall M. Hord and Ed V. Harrell in the presence of said testator and in the presence of each other as subscribing witnesses thereto, and that the said Sophia Cherry was at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age (that is more than twenty one years of age) and of sound and disposing mind and memory and not under any coercion or restraint as the said deponent verily believes and further deponent says not.

Sworn to and subscribed by the said Kendall M. Hord before me Otto L. Coyle Clerk of said Court at Shelbyville Indiana the lst day of March 1913.

          Whereupon it is ordered adjudged and decreed by the Court that said instrument in writing purporting to be the last Will of Sophia Cherry deceased is the last Will and Testament of Sophia Cherry deceased and is hereby admitted to probate and record in the Court.

          I Otto L. Coyle Clerk of the Circuit Court of Shelby County Indiana do hereby certify that the within annexed Will and Testament of Sophia Miller (sic) has been duly admitted to probate and duly proved by the testimony of Kendall M. Hord, one of the subscribing witnesses thereto that a complete record of said Will and of the testimony of the said Kendall M. Hord in proof thereof, has been by me duly made and recorded in Book 6 at pages 271 [272-273] of the record of Wills of said County.

          In Attestation Whereof I have hereunto subscribed my name and affixed the seal of said Court at Shelbyville Indiana this 1" day of March 1913.
