Last  Will  and  Testament  of

 
Cyrus  H.  Stone

In the Name of God, Amen.  I  Cyrus H Stone  of Hanover Township in the County of Shelby and State of Indiana, Do make and declare this my last Will an Testament in manner and form as follows:  
First I desire to buried after my decease wife as little expense as may be and without any funeral pomp.

First I give and desire unto my wife  Nancy Stone  all that my equal and Undivided half of the west half of the Northeast quarter of Section number twenty three in Township fourteen North, of Range Seven east  it being land sold at the land office at Brookville together with all the hereditaments and appurtinances there unto belonging and the Rents issues and profits thereof for and during the term of her natural life; and from and after the decease of my said wife I give and bequeath the said land, tenements and appurtenances Unto my Son  Martin Stone  upon condition that he will do and truly pay Such bequests and legacies as hereinafter shall be made and directed to be paid by him unto my other Children. -- -- -- --

I also give and bequeath to my daughter  Huldah Bailey  the Sum of thirty five dollars and seventy Cents. ---  
Also
I give and bequeath to my daughter  Sally Haney  the Sum of thirty five dollars and seventy Cents ---  
Also
I give and bequeath to my daughter  Marietta Prime[?]  the sum of thirty five dollars and Seventy Cents ---
Also I give and bequeath to my daughter  Lydia Hill  the Sum of thirty five dollars  Seventy Cents ---  
Also I give and bequeath to my daughter  Harriet Stone  the sum of thirty five dollars & Seventy Cents ---  
Also, I give and bequeath to my Daughter  Pamelia Bliven  the Sum of thirty five dollars & Seventy Cents.  
All of which aforesaid bequests or legacies to be paid by my Son Martin Stone within One Year after the decease of my aforesaid wife  Nancy Stone -- they being the bequests and legacies forming the Condition Upon which the above mentioned gift and bequest to him was made.

Also  I do further give and bequeath to my daughter  Hariet Stone  a certain bay three year old mare which I purchased from  John Sutton   Also One bed and bedding. --- --- ---
Also  I give and bequeath to my daughter  Lydia Hill  ten sheep.  Also  I do further give to my wife during her life the use of all my household goods bedding and other furniture together with two cows to be selected at her discretion and after her decease to remain[?] to my Surviving Children  All the rest and residue of my personal estate whatsoever and wheresoever, of what nature and kind soever the same may be and not herein before given and disposed of (after payment of my debts, legacies and funeral expenses together with the reasonable charges of my executor
I do give to my wife  Nancy Stone  her heirs and Assigns Absolutely:  And I do hereby constitute and appoint my natural brother  Ashbel Stone  Sole executor of this my last Will and Testament --- in witness whereof I have hereunto Set my hand and Seal the day and year first above written

his last Will and testament, in the presence of us, who at his request
and in his presence, and in the presence of each other, have subscribed
our names as witnesses thereto

You solemnly swear that you saw Cyrus H Stone  Sign, Seal and publish and declare the within writing as his last Will and testament;  that you believe he was, at the time of its execution, of Sound mind and memory; and that you Signed your Name thereto, as a witness, in the presence of the Said Testator and at his request.  So help you God.


State of Indiana   Shelby County  Sst

On the fourth day of September in the year of our Lord one thousand Eight hundred and thirty three Personally appeared before me the Clerk of the probate court of said County Abel Cole, who being by me duly sworn deposeth that he saw Cyrus H Stone sign seal and publish the within as his last Will and Testament and that he the said Testator was the the time thereof of sound mind and memory and that this deponent signed his name thereto as witness in the presence of and at the request of Said Testator
