Shelby County
Term, in the year eighteen hundred and forty six
The Grand Jurors for the State of Indiana empanelled, sworn and charged to
inquire within and for the body of the County of Shelby aforesaid, upon their
oath present that George McMahan late of said county on the first day of
September in the year eighteen hundred and forty five with force and arms in the
county of Shelby aforesaid, in and upon the body of one James Sexton in the
peace of said State then and there being, did make an assault, and him the said
James Sexton in a rude, insolent and angry manner did then and there unlawfully
touch, strike, beat and wound contrary to the form of the Statute in such cases
made and provided, and against the peace and dignity of the State of Indiana.

We command you to take into your custody the body of George McMahan if he may
be found in your bailiwick, and him safely keep, so that you have his body
before the Judges of the Shelby Circuit Court, on the first day of their next
term to be holden at the Court House in Shelbyville, on the fourth Monday of
August next, to answer unto the State of Indiana an Indictment for assault and
Battery.
And have you then there this writ

Be it Remembered, That on the 12 day of August in the year of our Lord, One
thousand eight hundred and forty six George McMahen,
Wm. G. Capp
Personally appeared before me, Alexander Miller, Sheriff of the County
aforesaid, who acknowledged themselves to owe and be indebted unto the State of
Indiana, in the penal sum of fifty dollars each, to be levied on their goods,
chattels, lands and tenements. Yet to be void on the following condition, to wit—that
the above bounden George McMahen Personally be and appear before the Judges of
the Shelby Circuit Court, on the first day of their next term, to be holden at
the Court House in Shelbyville on the first 3rd Monday in August next, and then
and there to answer the State of Indiana, on an Indictment for an Assault &
Battery

certain cause therein pending, between the State of Indiana Plaintiff and George
McMahan Defendant. And herein they may not fail at their peril. Have you then
