Frank Drake being duly sworn, on his oath, says that on the eleventh day of August, A.D., 1918, at the County of Shelby and State of Indiana, one
Jacob G. DePrez, late of said County, did then and there unlawfully and feloniously commit a violent injury upon the person of Frank Drake by then and there unlawfully, feloniously, purposely, angrily, and with premeditated malice striking, beating and thereby wounding the said Frank Drake, with a certain cane, which cane the said Jacob G. DePrez had and held in his hand, with intent then and there and thereby him, the said Frank Drake, unlawfully, feloniously, purposely and with premeditated malice to kill and murder, then and there being, contrary to the form of the statute in such cases made and provided and against the peace and dignity of the State of Indiana.
