William Hacker
complains of Smith Wingate and says that the defendant on the 25th day of December 1856 by his note a copy of which is filed herewith promised to pay James E. Robertson one day after date Six dollars and fifty five cents, who endorsed said note to the plaintiff which remains unpaid.
2d And the plaintiff further says that the said defendant on the 25th day of December 1856 by his note a copy of which is filed herewith promised to pay
William C. Miller and James E. Robertson tradeing[sic] under the name and style of
W. C. Miller & Co. one day after date two hundred and thirty five dollars and 72 cents who endorsed the note to the plaintiff which remains unpaid by which the said plaintiff says the Defendant is now indebted to him in the sum of two hundred and fifty dollars and on which the plaintiff demands payment.

The State of Indiana, to the Sheriff of Shelby County, Greeting:
You are hereby commanded to summon Smith Wingate if he may be found in your bailiwick to appear before the Judge of the Court of Common Pleas of Shelby County on the second day of the next term of said Court, to be held at the Court House in Shelbyville the first Monday in June 1857 then and there to answer the complaint of William Hacker Damages Claimed two hundred and fifty dollars and herein he may not fail at his peril; and have you then there this writ.
In Witness of Which, I Alex Miller Clerk of said Court, hereunto affix the seal thereof and subscribe my name at Shelbyville this 13th day of May A.D. 1857
