Shelby County      SS                                                         September A.D. 1859

            Jonathan Thompson  complains of  Jacob Vernon  and  Evans Elliott  doing business under the name and stile of  Elliott & Vernon and says that said defendant on the 26 day of March A.D. 1859 gave their note a copy of which is filed herewith promised to pay the Plaintiff the sum of Five hundred and Thirty Dollars that afterwards on the 26th day of March 1859 said defts.  Paid on said note the sum of five sixty two dollars and 70 cents and that the remainder of principal and interest on said note remains due and unpaid wherefore Plff. Demands Judgment of Eight hundred dollars and for other proper relief.

            Know all men by these presents the We Jacob Vernon and Evans Elliott doing business under the name and stile of Elliott & Vernon boath of the Town of Shelbyville in Shelby County and state of Indiana, do hereby constitute and appoint  Eden H. Davis Esq  an attorney of the Common Pleas Court of said County, or any other attorney of said Court our true and lawful attorney for us and in our names and place to appear at the present or any subsequent term of said court in and to a certain action or suit to be there brought against us by one Jonathan Thompson upon a certain promissary note executed by us under our said firm name of Elliott & Vernon on the 26th day of March 1858, wherein we promised to pay said Thompson on order the sum of Five hundred and thirty dollars Six months after the date thereof for value received without any relief from Valuation or appraisement laws and then and there or in said Court receive a complaint on said note against us, and waive the issuing and denial of peace against us therein and then and there in said Court confess Judgment against us for what shall be due of principal and interest on same together with costs and taxed therein and then and there enter up each Judgement of record in said Court against us making the same collectable without any relief whatever from Valuation or appraisement Laws according & the agreement contained in said note, and also then and there enter upon said record a relesal of all error in such proceedings and waiving all right and benefit of appeal therefrom and we hereby ratify all lawful acts of our said attorney done on the premises by virtue of these presents.

Davis a Notary Public in and for said County this 23rd day of September 1859 personally came Evans Elliott and Jacob Vernon who being duly sworn say they the said affiants constitute the firm of Elliott & Vernon, that the debt specified in the foregoing warrant of attorney is justly owing by them to the said Jonathan Thompson, the said warrant of attorney is not given nor the Judgment thereby authorized to be confessed for the purpose of hindering delaying or defrauding their creditors or any of them.
