I, James O. Hendricks, being duly sworn this 29th day of October, 1930, upon my oath depose and say that I live at 316 E. Franklin St., Shelbyville, Ind.
On October 25th, about one thirty o'clock I was standing at the White Rose filling station talking with Mr. Earl Shephard when I noticed Mrs. Miller, going east diagonally across the street. I noticed a machine come off of bridge and turned south on Vine Street, and saw Mrs. Miller step back into the path of the car, and I think the front wheels hit her, knocking her to the pavement. I walked over to where she was lying. I do not know whether she was concious [sic] or unconcious.
I judge the car was travelling eight miles an hour and the driver stopped immediately and offered his assistance. I think the accident was absolutely unadvoidable [sic].
Witness my hand this 29th day of October 1930
Attest: James O. Henricks /s/

On October 25th, about two o'clock I was at the White Rose filling station at the corner of Vine and Walker Streets. I heard a noise and looking towards street I saw a person lying on the street and went over and helped pick her up and carry her to her daughter's home and laid her on the bed.
I judge the lady was unconscious when we reached her.
The driver stopped his car immediately and helped with caring for Mrs. Miller, and asked for some one to call the ambulance and the doctor.

On Saturday, October 25th, I was driving to Shelbyville, with my wife, after having had dinner, to pay our taxes. I was driving south on Vine street and at the corner of Walker street I noticed a sign of 'Free Gas', at the White Rose filling station. I shut off my gas and was going to stop and go back an [sic] inquire about same.
At that instant I saw an old lady start across the street in front of me and to avoic hitting her I trned toward the right curb, and when front wheels had passed her, she suddenly stopped, turned, and threw up both hands (her eyes looked glassy) and fell into the front fender, on left side of car. I stopped my car immediately, got out, went back and assisted in taking her to her daughter's home. I had Earl Shephard call the doctor and police, and reported accident at police headquarters, myself. I I do not think I was travelling more that [sic] six miles an hour when I struck Mrs. Miller.
