This indenture made the twenty eighth day of May in the year our Lord one thousand eight hundred and thirty five between  Elisha Baker sheriff of the County of Shelby and state of Indiana of the first part and  Merry W. Smith  of the county and state aforesaid of the second part Whereas  Arthur McClure  lately before the Judge of the Shelby circuit court holden in the town of Shelbyville in the said county of Shelby towit at the term of September in the year of our Lord one thousand eight hundred and thirty four recovered by judgement of the said court against  Josiah Williams  the sum of seven dollars and sixty eight cents for his costs therefore to wit at the March term in the year 1834 in that suit occurred as also the further sum of nine dollars and ninty nine cents which were then and there by the said court adjudged to him for his costs and charges by him about his said suit in that behalf exponded as by the record thereof remaining in said court more fully appears And whereas the said Arthur McClure [cried?] out a certain writ of execution on the said judgement directed to the said Elisha Baker sheriff of said county by which said writ the said sheriff was commanded that of the goods and chattels, lands and tenements of the said Josiah Williams he should cause to be made the monies and the costs aforesaid and have those monies before the Judges aforesaid on a certain day Now past to render to the said Arthur McClure for his costs and charges aforesaid and also the said writ.  And whereas the state of Indiana lately before the Judges of the Shelby circuit court holden in the town of Shelbyville in the said county of Shelby towit at the September term of court in the year eighteen hundred and thirty four recovered by the Judgement of the said court against Josiah Williams the sum of twenty dollars and ninty five cents for her costs before then Towit at the September term in the year 1829 accrued as also the further sum of ten dollars and sixty two cents which were then and there adjudged to the said state of Indiana for her costs and charges by her in her said suit in that behalf expended as by the record thereof remaining in the said court more fully appears and whereas the said state of Indiana [cried?] out a certain writ of Execution of the said Judgement directed to the said Elisha Baker Sheriff of said county by which said writ the said Sheriff was commanded that of the goods and chattels lands and tenements of the said Josiah Williams he should cause to be made the said monies the costs and charges aforesaid and have those monies before the Judge aforesaid on a certain day now past

to render to the state of Indiana for her costs and charges aforesaid and also the said writ.  And whereas the state of Indiana lately before the Judge of the Shelby circuit court holden in the town of Shelbyville in the said county of Shelby towit at the September term of said court in the year eighteen hundred and thirty four recovered by Judgement of the said court against Josiah Williams the sum of six dollars and seventy cents for her costs before them in that suit accrued and also the further sum of nine dollars and ninety nine cents which were then and there adjudged to the said state of Indiana for her costs and charges by her also her said suit in that behalf expended by the record thereof remaining in said court Now fully appears and whereas the said state of Indiana [cried?] out a certain writ of execution directed to the said Elisha Baker sheriff of the said county by which said writ the said Sheriff was commanded that of the goods and chattels lands and tenements of the said Josiah Williams he should cause to be made the said monies the costs and charges aforesaid and have those monies before the Judge aforesaid ob a certain day Now first to render to the said state of Indiana for her said costs and charges aforesaid and also that writ. And whereas the said Elisha Baker sheriff as aforesaid in pursuance of the [????] writs levied upon and accrued the lands hereinafter described and having legally advertised the same did on the twenty second day of November in the year eighteen hundred and thirty four at and upon the premises in the said county of Shelby by public auction first expose to sale the rents and profits of the said lands for the term of seven years and no persons bidding for the same be when offered by public auction as aforesaid the fee simple of said land or all the estate right and title of the said Josiah Williams in and to the same and the said  Merry W. Smith did then and there bid for the same the sum of two hundred dollars and twelve and one half cents and no person bidding more the said tract or parcel of land was in due form openly and with appurtances was in due form openly struck of and sold to the said Merry W. Smith for the highest bidder and that the said sum of two hundred dollars and twelve and one half cents he being the highest bidder and that the highest and best price bidden for the same.  Therefore to confirm to the said Merry W. Smith the sale so made of aforesaid this indenture witnesseth that the said Elisha Baker Sheriff as aforesaid for and in consideration of the aforesaid sum of two hundred dollars twelve and one half cents to him in hand paid by the said Merry W. Smith the receipt whereof is hereunto acknowledged hath by virtue of the Laws of the state of Indiana granted bargained sold conveyed and confirmed and doth by these presents grant bargain sell convey and confirm unto the said Merry W. Smith his heirs and assigns forever all that certain tract or parcel of land lying and being in the county of Shelby aforesaid it being the East half of the South East quarter of section four in township Eleven North of Range [seven?] east containing eighty eight acres together with all the privileges [missing word] and appurtenances hereunto belonging with all [cannot make out next two words] interest and claim of the said Josiah Williams in and to the same name and every part thereof to have and to hold all and singular premises aforesaid with the appurtenances to the said Merry W. Smith

his heirs and assigns forever in a full complete and ample a manner as the said Josiah Williams had and held the same immediately before the [???] aforesaid executions. In witness whereof the said Elisha Baker sheriff as aforesaid hath hereunto set his hand and seal the day and year first above written.
