            An Inventory of the Estate, Real & personal, Lands, Tenements, Goods, Chattels and effects of  Richard S. Cummins, late of Shelby county Indiana, deceased, taken by John Walker and Royal Mayhew Executors with the assistance of  Thomas H. Fleming,  Voorhees Conover  and  Samuel Walker appraisers duly called for that purpose towit:

State of Indiana Shelby County SS:
            Before me John Morrison a Justice of the peace in and for said County, Personally appeared Royal Mayhew one of the Executors of the Estate of R. S. Cummins deceased, and Thomas H. Fleming, Samuel Walker & Voorhees Conover appraisers of said Estate, and being duly sworn, the said appraisers on their oath say that the said inventory and appraisement as signed by then is a Just and true inventory and valuation of the goods chattels and effect of said R. S. Cummins dec’d to the best of their Judgment, and the said Royal Mayhew says that the above is a true inventory of said estate so far as the same has come to his hands.

            We the undersigned having on this 16" day of May 1837 been called on by Royal Mayhew one of the executors of the last will and Testament of R. S. Cummins, late of Shelby County deceased to Appraise the lot of land with the buildings and appurtunances, whereon the said Richard S. Cummins resided at the time of his death being North of, and adjoining the town of Shelbyville on the West side of Harrison Street Which lot & appurtunances we have valued at Fifteen Hundred dollars.
            Given under our hand this 16" day of May 1839

            In the Probate Court of said County in open court comes the above named Voorhees Conover, Thos. H. Fleming and Sam’l Walker who being duly sworn on their oaths say that the above is a true valuation of the above lot according to the best of their Judgment and belief.

            Account of Sales of the personal property of Richard S. Cummins late of the County of Shelby and State of Indiana deceased, at a public auction held at the late dwelling house and also at the late apothecary Shop of said decedent on the fifth day of July 1838.

To the Honorable Jacob Kennerly Judge of Said Court
            The Memorial of John Walker and Royal Mayhew Executors of the last will and Testament of Richard S. Cummins late of said County deceased respectfully Sheweth that the personal Estate of the said Testator (contrary to the expectations of said Testator as appears by said Will) is insufficient for the payments of his debts as appears by the account herewith produced towit:
There was a deficiency in the Sale of personal Estate below the appraisement of about 200 00
The Widow took at the appraisement her hundred dollars 100 00
At the time of decedents death there was due secured by Mortgage on his real estate to Sinking fund 400 00
Mortgage on his real Estate to Rail Road Company 1400 00
Note given to John Allen by Hunt & Cumins for part of said real estate 150 00

            From which it appears necessary to make the real estate of said decedent assets in the hands of said Executors for the payment of said decedents debts. Your Memoralists therefore pray your Honor to grant them an order for the sale of said real estate either for private or public sale as the Executors best can for the interest of said estate, either for cash in hand or on a credit, either subject to or discharged of the incumbances now on said real estate in whole or in part as they shall think best for the interest of said Estate, and that the proceeds of said real estate be made assets in the hands of your Memoralists for the payment of said decedents debts, and other demands and expenses as may be necessary to pay in settling said Estate.
            And Your Memoralists further represent that the amount of the personal and real estate of said decedent when sold and made assets will be (as appears from the foregoing Statement of the Condition of said Estate) insufficient to pay and discharge the debts and demands outstanding against it. Your memoralists therefore pray that they may be allowed to settle the said Estate as insolvent in conformity with the Statute in such cases provided, that the creditors of said Estate may be notified accordingly, and that they may have such other and further relief as may be consistent with Justice and equity. And your Memoralists will ever pray &c. May 17, 1839

            Be it known that  Marsten Allen  of the firm of Allen & Co. personally appeared before me the subscriber a Justice of the peace in and for said County being duly sworn according to law, deposeth and saith that the within account against the firm of Cummins and Barker amounting to three hundred and three dollars and forty one cents is Just and true and that the several items conferring said account has delivered to said firm of Cummins & Barker and that there are no credit payments now set off against said account Except there as within set forth.
            Sworn to and subscribed before me this 28th day of January 1840
