          Said Trustee shows that said funds were received by him under and by virtue of the provisions of the will of Nancy E. Rothrock, deceased and from himself as Executor of said will. That by the terms of said will he as such Trustee was directed to use the net proceeds of said funds for the support of said Eliza Kelly during her life but if her wants and necessities should require it he was directed to use such part of the principal thereof as in his Judgment might be necessary. That said Eliza Kelly departed this life on the 20" day of July 1894. That for a number of years prior to her death she made her home with  Edwin H. Harker  [Harlan - pmf] and his family. That said Eliza Kelly was old and feeble and this Trustee made a contract with said Harker to take care of her agreeing to pay said Harker such reasonable amount for his services as he might be able to pay with the funds in his hands. That under said arrangement said Harker did take care of said Eliza Kelly until her death. That said Harker has presented to this Trustee a claim for his services in the sum of $493.00.

Thomas S. Caughey  would respectfully show to the Shelby Circuit Court that by virtue of the provisions of the last Will and Testatment[sic] of  Nancy E. Rothrock dec'd he was designated as Trustee for the benefit of  Mrs Eliza Kelley  of certain funds arising from the Estate of said decedent:  That said Estate is fully settled, and the funds for the use of said Eliza Kelly amount to the sum of $1199.16, and which will be transferred to the Trustee under the provisions of said will when ever an appointment is made.
          Wherefore he asks that he may be appointed such Trustee.

[There are also yearly receipts from the Treasurer's Office in Shelbyville, IN.  Evidently the trustee had to pay personal property tax on the monies he was holding for Eliza here in Shelbyville.]

[The trustee submitted a report to the court every two years.  Prior to 1887, Mr. Caughey had been investing (at eight percent) all monies not being used by Eliza Kelley.  The end of this report explains a change.]

Filed Mar 28 1887...
Said Trustee shows that he has not charged himself with interest on said funds for the following Reasons.  Said Eliza Kelly is very old and feeble and it is necessary for this Trustee to keep a considerable amount of said money on hands at all times with which to provide for her  That he has been unable to loan out such part of said money as he might have loaned, to such persons as he considered proper persons to loan the same to    That said money in his hands has laid in Bank bringing him no interest and not used by him in his own business   That he has had Three Hundred dollars of said amount loaned out at interest for about six months which interest he expects to charge himself with when collected.   That on account of his not realizing any interest on said funds he makes no charge for his services during the last two years.
Wherefore said Trustee asks that this his Report be approved and that his trust be continued two years.

Said Trustee shows that said Eliza Kelly lives with her nephew one Edward Harlan* at New Market Montgomery County Indiana   That she is very old and feeble being over eighty years of age....

Per the notes in POB 44 (Shelby Co IN), Eliza D Fleming Harlan Kelley died 18 Jul 1894 in Terre Haute, Vigo Co, IN, where she had been taken to the hospital.  At the time, she was living with her grandson in New Market, IN.  The papers above give his relationship as nephew, and the POB gives his surname as Harbor/Herber, but his given name was  Edwin Howe Harlan, the son of Eliza's oldest son, John Gregg HarlanNancy Elizabeth Harlan Rothrock (the person who established the above trust) was Eliza's daughter.
