Pleas held at the Court house ion Shelbyville in and for the County of Shelby in the State of Indiana before the Honorable Jacob Kennerly Judge of the Probate Court of Shelby County aforesaid on Monday the Eleventh day of February in the year one thousand and eight hundred and Thirty nine.

            Be it remembered that heretofore, towit: On the first Judicial day of a term of the Court aforesaid held as aforesaid before the Honorable Erasmus Powell Judge of the Probate Court aforesaid of the Term of November in the year of our Lord one thousand eight hundred and thirty two.
            Come now the said Amos Fox and Mary Ann Fox and move the Court to appoint John Clark of the County of Shelby and State of Indiana, their Guardian, and the Court being advised of and concerning the premises it is ordered by the Court that the said John Clark be appointed guardian of Amos Fox and Mary Ann Fox Heirs of John Fox deceased. Whereupon the said John Clark guardian as aforesaid files in open Court a Bond with good security in the penal sum of ninety one dollar conditioned for his faithful performance as Guardian as aforesaid which bond is approved of and excepted of by the Court And the said John Clark here now in open Court solemnly swears that he will faithfully discharge the trust devolving upon him as Guarding as aforesaid.
            And afterwards; towit on the first Judicial day of a term of the Court aforesaid held as aforesaid before the Honorable the Judge first aforesaid on Monday the Eighth day of February in the year of our Lord one thousand eight hundred and thirty six.
            Comes now the said Guardian and files an inventory and account which said inventory in the words (and figures) following towit:

            To the Honorable Jacob Kennerly Judge of the Shelby Probate Court the undersigned John Clark makes the following exhibit:

            Received from Daniel Heck on the twelfth of November one thousand eight hundred and thirty two Fifty five dollars twelve and a half cents

John Clark Guardian

Comes now the said Guardian and files his petition in the words following towit:
            State of Indiana Shelby County Probate Court of Shelby County
            May Term one thousand eight hundred and thirty seven
            Jacob Kennerly Judge of the Probate Court of Shelby County.

            The memorial of John Clark guardian of the person and estate of  Mary Ann Fox, respectfully sheweth that whereas John Fox, late of Shelby County, Indiana died intestate and seized in fee simple of South West quarter of south West quarter of section twenty-two , in township Eleven north of Range Six East containing forty acres, leaving Amos Fox, Nelly Fox, John Fox and the said Mary Ann Fox his only children and only next of kin him surviving, and that the personal Estate of the said Mary Ann which has come to the hands of your memoralist is insufficient for her sustenance and education and that her one fourth part of the said tract of land is a part of her real estate. Your memoralist therefore prays that your honor would make an order for the appointment and Sale of the said premises and that he avails of the same may be made a fund in the hands of your memoralist for the sustenance and education of the said Mary Ann during her minority and your memoralist will ever pray and so forth.
            May Eighth one thousand eight hundred and thirty seven             John Clark

            And the premises being seen, the Court here now appoints  Henry Kirk, Jacob Mullendore  and  George Earlywine  [appraisers] of the real estate of the said minor named and described in said petition; towit:  the North West quarter of the South West quarter of section thirty-two in Township Number Eleven North of range six east, or the interest of the said Mary Ann herein being the one equal undivided fourth part thereof, and the said Appraisers are requested after being duly sworn to appraise the interest of the said Mary Ann Fox in and to said real estate, and make report thereof in writing under their hands to this Court at the next term and this cause is continued.
            And afterwards: towit: on the first Judicial day of a term of the Court aforesaid held as aforesaid before the Honorable the Judge first aforesaid on Monday for the fourteenth day of August in the year last aforesaid.
            Comes the said Guardian and Jacob Mullendore and William H. Kirk, two of the said appraisers personally came also and file their report in the words following, towit:
            We the undersigned, appointed by the within order to appraise the premises therein described, having been sworn according to law, do report, that on due consideration and examination of the premises we are of opinion that the said lot, with its appurtenances and improvements is worth one hundred and eight dollars, and appraise the same according this eleventh day of August in the year of our Lord one thousand eight hundred and thirty seven.
