Last Will and Testament of
Elizabeth Hamilton


            I,  Elizabeth Hamilton, of the City of Shelbyville, Shelby County, in the State of Indiana, being of sound mind and memory, do make this my last Will and Testament, hereby revoking any and all wills heretofore made by me.

            Item 1.  I give, devise and bequeath to  Joseph H. Pattison,  Emma Kleinschmidt,  Samuel L. Pattison,  Day Pattison  and  George C. Pattison, each the sum of One Thousand (1000.00) Dollars.  Said parties all live in the City of Indianapolis, Indiana.

            Item 2.  I give, devise and bequeath to the following named parties the amount respectively set opposite their names:
To my cousin  Hattie Biggers $500.00
To my Cousin  James Moffatt
      of Limavady, Londonderry County, Ireland
$500.00
To  Lula Tinsley, daughter of the late  Rev. Charles Tinsley,
      of Indianapolis, Indiana
$400.00
To  Margaret J. McMillin of Londonderry County, Ireland $500.00

To  Anna B. McMillin $500.00
To  Virgil Schultz $500.00

            Item 3.  I give, devise and bequeath to the Trustees of Magilligan Presbyterian Church of Limavady, Londonderry County, Ireland, the sum of Five Hundred ($500.00) Dollars, which sum is to be held in trust by said trustees for the purpose of maintaining and improving the cemetery of said church where my sister, Anna Rose is Buried.

            Item 4.  I give, devise and bequeath to the Board of Trustees of Drumachose Presbyterian Church of Limavady, County Londonderry, Ireland, the sum of Three Thousand ($3000.00) Dollars.

            Item 5.  I give, devise and bequeath to the Gordon Orphans Home, of Shelby County, Indiana, the sum of Five Hundred ($500.00) Dollars.

            Item 6.  All the residue of my estate of whatever nature and description, I give, devise and bequeath to Samuel Laughlin, my brother-in-law.

            Item 7.  I appoint Samuel Laughlin as executor of this will, and in case he is not living at my decease, or for my cause does not qualify as such, I appoint Dr. Walter C. McFadden as such executor.

            In testimony whereof I have hereunto set my hand and seal at the City of Shelbyville, Shelby County, in the State of Indiana, this 17th day of May, A.D. 1915.

The above and foregoing will was signed, sealed and acknowledged by the said Elizabeth Hamilton, in our presence, and was declared by her to be her last will and testament, and at her request and in her presence, and in the presence of each other we now subscribe our names hereto as witnesses, and for the purpose of identification we place upon each page thereof, the initials of our names.  This 17th day of May A.D. 1915

            Be it remembered, that on the 6th day of November, A.D. 1916 the 31 judicial day of the October Term of the Shelby Circuit Court in said year, come into open Court Samuel Laughlin and produces in Court an instrument in writing purporting to be the last Will and Testament of Elizabeth Hamilton, deceased, and now moves the admittance thereof to probate and record, and in proof of said Will introduces James B. Kennedy the subscribing witnesses thereto, who being duly sworn by the Clerk of said Court, on oath, declare and testify as follows, that is to say:  That on the 17th day of May, 1915 he saw the said Elizabeth Hamilton sign her name to said instrument in writing as and for her last Will and Testament; and that this deponent at the same time, heard the said Elizabeth Hamilton declare the said instrument in writing to be her last Will and Testament and that the said instrument in writing was, at the request of the said Elizabeth Hamilton and with her consent attested and subscribed by the said James B. Kennedy and George H. Meiks in the presence of said testator, and in the presence of each other, as subscribing witnesses thereto, and that the said Elizabeth Hamilton, at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age (that is, more than twenty-one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint; as the said deponent verily believes, and further deponent says not.

Whereupon it is ordered, adjudged and decreed by the Court that said instrument in writing purporting to be the last Will of Elizabeth Hamilton deceased, is the last Will and Testament of Elizabeth Hamilton deceased, and is hereby admitted to probate and record in this Court.

            I, Cecil B. Collins Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the within annexed Will and Testament of Elizabeth Hamilton has been duly admitted to probate, and duly proved by the testimony of James B. Kennedy one of the subscribing witnesses thereto, that a complete record of said Will, and of the testimony of the said James B. Kennedy in proof thereof, has been by me duly made and recorded in Book 7 at pages 174 & 175 of the record of Wills of said County.

            In testimony whereof, I have hereunto subscribed my name, and affixed the seal of said Court, at Shelbyville Indiana, this 6th day of November 1916.

Codicil to Will

            I, Elizabeth Hamilton, of the City of Shelbyville, Shelby County, in the State of Indiana, having heretofore executed my last will and testament bearing date of May 17th, 1915, do make and publish this a codicil thereto.

            First.  In the event that my brother-in-law Samuel Laughlin, shall not be living at the time of my death, it is my will and I hereby will, provide, devise and direct that the one half part of the residue of my estate remaining after the payment of the bequests made in my said will, shall go and be paid to Hanover College, in the State of Indiana, that is to say to Hanover College Corporation, to be kept by the trustees of the said College and made by them for a part of “The Samuel Laughlin Fund” to be invested by them for the same purposes and in the same manner as other money belonging to the said “The Samuel Laughlin Fund” and the remaining one-half part of such residue shall be and is hereby bequesthed for the purpose of establishing a Young Mens Christian Association in the City of Shelbyville, Indiana, or if the same shall have been established before my death then said sum shall be turned over to the directors of the same, or to those legally in control of the same, to be used by them in improvement, equipment, or maintenance of the same, as said body shall deem best.  My said executor is charged with carrying out this bequest, and is hereby authorized to pay said sum to said Board of control of said Young Mens Christian Association, either in case said association is in existence at the time of my death or in case it shall be organized and established before my estate is finally settled, and in case no Young Mens Christian Association shall have been duly organized and established in the said City before the final settlement of my estate, then all the said residue shall be paid by him to the said Hanover College Corporation, to become a part of and to be used as a part of the funds belonging to “The Samuel Laughlin Fund” above mentioned.  It being my intention and desire that this item of this codicil to my said will shall be of effect only in the event that my said brother-in-law, Samuel Laughlin shall not be living at the time of my death.

            Second.  It is my wish, and I hereby direct that the funds belonging to my estate shall be deposited in the First National Bank, of Shelbyville, Indiana, pending the settlement of my estate, in so far as it is necessary to deposit such funds in any bank.  And I request the executor of my said Will, therein named, to employ George H. Meiks, as attorney to assist him in the settlement of my estate.

            In Witness Whereof, I have hereunto set my hand and seal, this 30th day of August, A.D., 1915.
