Last Will and Testament of
Joseph  Paul


            I,  Joseph Paul  of Shelbyville, Shelby County Indiana, being of sound mind and disposing memory do hereby make and declare this to be my last will and testament, hereby revoking any and all wills by me heretofore made.

            Item 1.  I hereby direct that my executor herein after named shall pay all of my just debts including the debts made by my last sickness and funeral expenses and that he erect a monument suitable to our station in life upon our Lot in St. Joseph Catholic Cemetery, said monument not to cost to exceed $300.00.

            Item 2.  I will, devise and bequeath Fifty ($50.00) dollars for masses for the repose of my poor soul and the poor soul of my wife  Mary Ann Paul,  the same to be paid to my executor ½ after my death and ½ at the death of my beloved wife, the same to be paid to the Pastor of St. Joseph’s Catholic Church of Shelbyville Indiana.

            Item 3.  I will devise and bequeath the residue of my estate both personal and real estate to my beloved wife Mary Ann Paul for and during the term of her natural life and for that time only she is to have full control and management of the same and to receive all the proceeds therefrom except that she is to keep up the insurance of the buildings on my real estate and pay all taxes accruing from the rents and earnings derived therefrom.

            Item 4.  At the death of my beloved wife should she out live me and if not that at my death I will, devise to my beloved Children the following:  To my daughter  Katie Wagner  One hundred ($100.00) dollars, to my daughter  Lena Fastlaben  One hundred ($100.00) dollars and to my daughter  Anna Larrimore,  One hundred ($100.00) dollars and to my son  Lewis Paul  the sum of Fifty ($50.00) dollars, the same to be paid by my executor within Twelve months after my beloved wife’s death should she out live me and if she die before me then within Twelve months after my death the same not to draw any interest for said Twelve months.

            Item 5.  After complying with the foregoing items of this will the residue of my estate, personal, real and mixed I will, devise and bequeath absolutely and in fee simple to my son  Joseph A. Paul.

            Item 6.  I hereby nominate and appoint my beloved son Joseph A. Paul as the executor of this my last will and testament.

            Witness my hand and seal this 6th day of November 1911.

            The foregoing instrument signed, sealed and declared to be the last will and testament by the said Joseph Paul in our presence, who at his request us in his presence and in the presence of each other have subscribed our names as witnesses thereto, this 6th day of November 1911.

            Be it remembered that on the ____ day of August A.D. 19__ the ____judicial day of the May Term of the Shelby Circuit Court in said year, come into open Court, John H. Siefert and produces in Court an instrument in writing purporting to be the last Will and Testament of Joseph Paul, deceased, and now moves the admittance thereof to probate and record, and in proof of said Will introduces John H. Siefert the subscribing witnesses thereto, who being duly sworn by the Clerk of said Court, on oath, declare and testify, as follows, that is to say:  That on the 6th day of November 1911, he saw the said Joseph Paul sign his name to said instrument in writing as and for his last Will and Testament; and that this deponent, at the same time, heard the said Joseph Paul, declare the said instrument in writing to be his last Will and Testament, and that the said instrument in writing was, at the same time, at the request of said Joseph Paul, and with his consent attested and subscribed by the said John H. Siefert and Thomas H. Campbell in the presence of said testator, and in the presence of each other, as subscribing witnesses thereto, and that the said Joseph Paul was, at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age (that is, more than twenty-one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint, as the said deponent verily believes, and further deponent says not.

            Whereupon it is ordered, adjudged and decreed by the Court that the said instrument in writing purporting to be the last Will of Joseph Paul, deceased, is the last Will and Testament of Joseph Paul, Deceased, and is hereby admitted to probate and record in this Court.

            I, Cecil B. Collins Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the within annexed Will and Testament of Joseph Paul has been duly admitted to probate, and duly proved by the testimony of John H. Siefert, one of the subscribing witnesses thereto, that a complete record of said Will, and of the testimony of the said John H. Siefert, in proof thereof, has been duly made and recorded in Book 7 at pages 143 & 144 of the record of Wills of said County.

            In Attestation Whereof, I have hereunto subscribed my name, and affixed the seal of said Court, at Shelbyville, Indiana, this 5 day of Aug. 1916.

            I, Mary Paul being the widow of Joseph Paul late of Shelby County Indiana, hereby declare that I have heard the last will of my deceased husband read and know the provisions therein made for me and I now and hereby accept the provisions therein made from in lieu of my right or claim I might make as his widow under the laws of the State of Indiana.
