Last Will and Testament
of
Sarah E. Caudell
I, Sarah E. Caudell, of Shelby County, Indiana, being of sound mind and disposing memory do hereby make publish and declare this to be my last will and testament, hereby revoking any and all former wills by me at any time made.
Item 1. I will, devise and bequeath to my son William C. Caudell all the real estate wheresoever located of which I shall die seized, subject to the conditions hereinafter stated, to have and to hold the same in fee simple.
Item 2. The conditions of the bequest at item one of this will are that my said son William C. Caudell, shall pay all my just debts and funeral expenses, and shall pay to each of my other three sons, Charles E. Caudell, Harley O. Caudell and Martin C. Caudell the sum of fifty ($50.00) dollars, said sum of fifty dollars to be paid to my other three sons herein stipulated to be a lien on the real estate of which I may die seized.
Item 3. I will and devise all of my personal property of every kind and description and wheresoever located, of which I may be the owner at the time of my death, to my said son William C. Caudell, the devise and bequest of my real estate and personal property made herein to my son William C. Caudell is so made in consideration of my love, and affection for him and for the reason of the love, care and attention he has shown to and bestowed upon me in my old age and in sickness.
Item 4. I hereby nominate and appoint my said son William C. Caudell as executor of this my last will and testament and will and direct that he serve as such executor without bond.
In witness whereof I hereunto subscribe my name this the 4th day of August, 1916, in the presence of J. Oscar Hall and Josephine Caudell whom I have requested to become attesting witnesses hereto.

The foregoing instrument was signed by Sarah E. Caudell and declared by her to be her last will and testament in our presence and in the presence of each of us, and we at the same time and in her presence and at her request and in the presence of each other hereunto subscribe our names as attesting witnesses hereto, this 4th day of August, 1916.

Be it remembered, That on the 20 day of September 1916, J. Oscar Hall one of the subscribing witnesses to the within and foregoing last Will and Testament of Sarah E. Caudell late of Said County, deceased, personally appeared before Cecil B. Collins Clerk of the Circuit Court of Shelby County, in the State of Indiana, and being duly sworn by the Clerk of said court, upon his oath, declared and testified as follows, that is to say: That on the 4th of August 1916 he saw the said Sarah E. Caudell sign her name to the said instrument in writing as and for her last Will and Testament; and that this deponent, at the same time, heard the said Sarah E. Caudell declare the said instrument in writing to be her last Will and Testament, and that the said instrument in writing was, at the same time, at the request of the said Sarah E. Caudell and with her consent attested and subscribed by the said J. Oscar Hall & Josephine Caudell in the presence of said testator, and in the presence of each other, as subscribing witnesses thereto, and that the said Sarah E. Caudell was, at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age (That is, more than twenty-one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint, as the said deponent verily believes, and further deponent says not.

I, Cecil B. Collins Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the within annexed Will and Testament of Sarah E. Caudell has been duly admitted to probate, and duly proved by the testimony of J. Oscar Hall one of the subscribing witnesses thereto, that a complete record of said Will, and of the testimony of the said J. Oscar Hall in proof thereof, has been by me duly made and recorded in Book 7 at pages 153 & 154 of the record of Wills of said County.
