Last Will
of
Joseph Odell
deceased
In the Name of the Benevolent Father of all I Joseph Odell of Shelby
County & State of Indiana being of Sound mind and memory do make and
Publish this my last will and testament
Item 1st I give and devise to my beloved wife in lieu of her interest
in my Estate both real & personal one hundred dollars to be paid out of my
Estate by Executors herein after mentioned at the expiration of (2) years
after my decease. And I hereby give and devise unto my beloved wife Sally
the following described property to be delivered to her upon her request at
anytime after my decease by Said Executors towit One Red Cow (the Bell cow)
& calf also a yearling calf belong to the same Cow also her Bed and Beding
my Said wife brought to my house with her and also another Bed She has made
since Marriage two (2) Choice Hogs that is now in the pen with use and
privilege of any growing crops & garden at the time of my decease. One new
Carpet with her Safe and all her wearing appearell. One Breckfast table and
cover One stand Table and cover also all the Fowels on hand at the time of my
decease two (2) sides of Pickle Meat one Side of Bacon two (2) hams of Bacon
and four (4) gallon Jar of Lard One Whash tub one Rocking Chair with all
whatsoever property She brought to my house at the time of our Marriage One
new Set Knives & forks and a certain set White dishes She claims
Item 2nd It is my will that all my Just debts and funeral expenses be fully
Paid by my Executors hereinafter mentioned.
Item 3rd I give and devise unto the living children of John Odell
deceased at the time of my decease One hundred and fifty dollars to be divided
equally between them and be paid them out of my estate at the expiration of
two years from my decease by my Executors hereinafter named.
Item 4th I give and devise unto the living Children of Jeremiah Odell Jr.
One hundred and fifty dollars to be divided equally between them and paid out
of my Estate by my executors at the expiration of two (2) years from my
decease.
Item 6th I give and devise unto my Daughter Nancy Andrews Seventy
five dollars to be paid her out of my Estate by my Executors in two years
after my decease.
7th I give and devise unto my daughter Elizabeth Teeple Seventy five
dollars to be paid out my estate by my Executors in two years after my decease
Also my bed bedstead and Bedding to be given her on her request after my
decease.
8th I give divise and bequeath unto James D. Odell, Martin V. Odell
the Sixty acre tract of Land on which I now reside and this bequest is upon
the condition that the said James D. Odell and Martin V. Odell will pay to the
legatees above named Five Hundred & Seventy-five ($575) of the cash
payments to them
Item 9th I give & devise unto Harden C. Odell Sixteen acres of
Land more of less the tract I own immediately North of the tract upon which he
lives and this bequest is upon the condition that he will pay two hundred
dollars of the cash payment to the legatees above named Also I give &
devise unto H. C. Odell my writing desk
Item 10th I give and devise unto James D. Odell my interest in a reping
machine and I give unto Martin V. Odell my Clock and I give devise &
bequeath unto Harden C. Odell, James D. Odell & Martin V. Odell the
residue of my Estate at the time of my decease after paying all my debts
funeral expences and Legatees above named and expences of settling my estate
to be divided equally between them
Item 11th I hereby nominate & appoint Harden C. Odell James D. Odell
& Martin V. Odell Executors of this my last will & testament I do
hereby revoke all former wills by me heretofore made
In witness whereof I have hereunto set my hand and seal this 15 day of June
AD 1864

testament in our presence and Signed by us in his presence.

hereby certify that the within last will of Joseph Odell late of Shelby County
Indiana deceased has been duly admitted to probate that its due execution was
this day proven by Isaac Odell and Joseph D. Lacy whose proofs together with
Such Will have been duly Recorded on pages 128 & 129 of the Record of
Wills in our office
In testimony whereof I have hereunto Subscribed my Name and Affixed the
Seal of Said Court at Shelbyville this 31st day of October 1864
