Albert P. Harrell, deceased.

I, Albert P. Harrell, at this time a resident of Shelby County, Indiana and being of sound and disposing mind and memory do hereby make and declare this to be my last will and testament, hereby revoking any and all former wills by me heretofore made.
Item One. It is my will and I hereby direct my executrix hereinafter named, as soon after my death as may be practical, to pay and discharge all of my just and legal debts, including expense of my last sickness and funeral.
Item Two. All the property of which I die seized, of whatever kind and character, real, personal or mixed, after the payment of my debts and the expenses provided to be paid in item one above, I hereby give, devise and bequeath to my beloved wife Olive Harrell, she to take the same absolutely and in fee simple.
Item Three. I hereby nominate and appoint my said wife Olive Harrell as the executrix of this my last will and testament and request her to secure the services of John A. Tindall Attorney in the settlement of my estate and all matters connected with this my said last will.
And in witness of this my last will and testament I have hereunto subscribed my name and affixed my seal this 17th day of August, 1917, at the city of Shelbyville, Indiana.

On this 17th day of August, 1917, Albert P. Harrell, to us well known, signed and sealed the above and foregoing instrument, in our presence and hearing and declared the same to be his last will and testament; and we, the undersigned, in his presence and hearing and in the presence and hearing of each other, and at his request have hereunto subscribed our names as witness to and of said last will and testament, at the city of Shelbyville, Indiana, this 17th day of August, 1917.

STATE OF INDIANA, SHELBY COUNTY, SS:
Be it remembered, that on the 7th day of February, A. D., 1918, the 28th Judicial day of the January Term, of the Shelby Circuit Court in said year, came into open Court John A. Tindall and produces in court an instrument in writing purporting to be the last will and Testament of Albert P. Harrell, deceased, and now moves the admittance hereof to probate and record, and in proof of said will introduces John A. Tindall, one of the subscribing witnesses thereof, who being duly sworn by the Clerk of said Court, on oath, declare and testify as follows, that is to say: That on the 17 day of August 1917, he saw the said Albert P. Harrell sign his name to said instrument in writing as and for his last Will and Testament; and that this deponent, at the same time, heard the said Albert P. Harrell declare the said instrument in writing to be his last Will and Testament, and that the said instrument in writing was, at the same time, at the request of said Albert P. Harrell and with his consent subscribed by the said John A. Tindall and William A. Yarling in the presence of said testator, and in the presence of each other, as subscribing witnesses thereto, and that the said Albert P. Harrell was, at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age (that is, more than twenty one years of age), and of sound and disposing mind and memory and not under any coercion or restraint, as the said deponent verily believes, and further deponent says not.

Whereupon it is ordered, adjudged and decreed by the Court that said
instrument in
writing purporting to be the last Will of Albert P. Harrell, deceased, is the
last Will and
Testament of Albert P. Harrell, deceased, and is hereby admitted to probate
and record in
this court.

I, Cecil B. Collins, Clerk of the Circuit Court of Shelby County,
Indiana, do hereby
certify that the within annexed Will and Testament of Albert P. Harrell has
been duly
admitted to probate and duly proved by the testimony of John A. Tindall one
of the
subscribing witnesses thereto, that a complete record of said Will, and of
the testimony of
the said John A. Tindall in proof thereof, has been by me duly made and
recorded in Book
7 at Pages 276-277 of the Record of Wills of said County.
IN ATTESTATION WHEREOF, I have hereunto subscribed my name and

I, Olive L. Harrell,
widow of Albert P. Harrell deceased late of Shelby
County, Indiana who died testate, and whose last will and testament has been
duly admitted to probate and recorded in Will recorded No Page in the Shelby
Circuit Court in said County and State hereby elect to take and accept the
provisions made by said will in my favor in lieu of all my rights and
interest as such widow under the statute of decent in and to all real estate
and personal property of which my said husband died siexed and which
statutory rights in consideration of the provision of said will by my
accepted as aforesaid, is hereby relinquished and released.

Notary Public in and for said county and state OLIVE L. HARRELL widow of
ALBERT P. HARRELL deceased to me well known and having fully explained to her
