Last  Will  and  Testament
of
Armilda  J. Hughbanks
deceased


I,  Armilda J. Hughbanks,  do hereby make and publish this my last Will and Testament, hereby revoking all former Wills by me made.

Item One, I direct and will that all of my just debts be fully paid.

Item Two,  I will, devise and bequest unto  Armilda Henry Girrard (sp?) daughter of my brother  Frank Henry,  the sum of One hundred dollars.

Item Three,  I will, devise and bequest unto my husband,  William Franklin Hughbanks  all the residue of my personal property after the payment of my said debts and the bequest to Armilda Henry named in Item two (2) of this Will.

Item Four,  I hereby will and direct that my executor hereinafter named shall sell and depose of my real estate known as the  Sam Oldfield  farm consisting of about fifteen acres and purchased from  Harry Roth  and after such sale shall have been made, I will, devise and bequest unto my sister-in-law  Barbara Henry  and her children,  Opal Henry,  Annie Jane Henry,  Lettia May Henry  and  Edith Henry  each the sum of two hundred dollars ($200.00) the whole aggregating the sum of $1,000.00 the same to be paid out of the proceeds of said sale.

Item Five,  I will, devise and bequest unto my husband William Franklin Hughbanks the residue of the proceeds of said sale after the payment of the bequest of $1,000.00 the same to be paid out of the proceeds of said sale.

Item Six,  I hereby give, will and devise and bequeath all of the residue of my real estate to my husband William Franklin Hughbanks for and during the term of his natural life, and for that term only and at his death I will devise and bequeath said real estate to my adopted son,  Harry E. Hughbanks  the same to be held by him for and during the term of his natural life and for that term only.

Item Seven,  I hereby give, will, devise and bequeath the said residence of said real estate as mentioned in said Item Six to the children of said Harry E. Hughbanks, who are living at the time of the death of said Harry E. Hughbanks, share and share alike in fee simple provided that if any of the children of said Harry E. Hughbanks shall be dead at this time of his death, I will, devise and bequeath to the descendants of said descended child or children the share that their father or mother as the case may be, would have been taken under this Will and had he or she been living at the time of the death of my said adopted son, provided that if said Harry B. Hughbanks shall have no children or their or their descendants living at the time of his death then I will, give devise and bequeath said residue of said real estate to the children of my deceased brother, Willis Henry, to wit;  Oral Henry,  Annie Jane Henry,  Letitia May Henry  and  Edith Henry and to  Ruth Bogan  the child which I got from the Guardian's Orphans' Home and to  William Franklin Brooking  and  Frederick Brooking  share and share alike in fee simple, provided that if any of said last named legatees shall be dead and have children living at the time of the death of said Harry E. Hughbanks or their descendants living at such times, then I will and direct that such children or their descendants shall take the share which their parent or grandparent at the case may be would have taken had he or she been living at such time.

Item Eight,  I hereby name and appoint my husband William Franklin Hughbanks as my executor of this my last Will and Testament.

          Witness my hand and Seal this 17th day of April, 1912.

          The foregoing instrument signed, sealed and acknowledged by said Armilda J. Hughbanks as and for her last Will and testament in our presence, who, at her request in his presence and in the presence of each other, have subscribed our names as witnesses thereto the 17th day of April 1912.

          Be it remembered, That on the 24th day of July 1912 Herbert C. Jones one of the subscribing witnesses to the within and foregoing last Will and Testament of Armilda J. Hughbanks late of said County, deceased, personally appeared before Otto L. Coyle, Clerk of the Circuit Court of Shelby County in the State of Indiana and being duly sworn by the Clerk of said Court upon his oath declares and testified as follows that is to say, That on this 17th day of April 1912 he saw the said Armilda J. Hughbanks sign her name to the said instrument in writing as for her last Will and Testament and that this deponent at the same time, heard the said Armilda J. Hughbanks declare the said instrument in writing to be her last Will and Testament and that the said instrument in writing was at the same time, at the request of the said Armilda J. Hughbanks and with her consent attested and subscribed by the said Herbert C. Jones in the presence of said testator, and in the presence of each other, as subscribing witness thereto and that the said Armilda J. Hughbanks was at the time of the signing and subscribing of said instrument in writing as aforesaid of full age that is more than twenty one years of age and of sound and disposing mind and memory and not under any coercion or restraint, as the said deponent verily believes and further deponent says not.

          I, Otto L. Coyle Clerk of the Circuit Court of Shelby County, Indiana do hereby certify that the within amended Will and Testament of Armilda J. Hughbanks has been duly admitted to probate and duly provided by the testimony of Herbert C. Jones, one of the subscribing witnesses thereto that a complete record of said Will and of this testimony of the said Herbert C. Jones and proof thereof, has been by me duly made and recorded in Book 6 at Pages 160-161-162-163 of the record of Wills of said County.

          In attestation Whereof, I, have herewith subscribed my name and affixed the seal of said Court at Shelbyville this 24th day of July 1912.
