Last Will
of
David
Pope, Deceased
I, David Pope , at this time a resident of Shelby County Indiana, and being of
sound and disposing mind and memory, do make, publish and declare this to be
my last Will and Testament, hereby revoking any and all former Wills by me
made.
Item 1. It is my will that all my just debts and funeral expenses be paid by
my Executor as soon after my death as practicable.
Item 2. I will, devise and bequest to my beloved wife, Harriet S. Pope, all;
my Personal Property and m neys (sic) of whatsoever kins (sic) and
wheresoever situated, to have and to hold as her absolute property.
Item 3. I will, debise (sic) and bequeath to my beloved wife, Harriet M.
Pope, for and during the term of her natural life, and for that term only,
the following described real estate situated in Shelby County Indiana,
to-wit: Beginning at the North West Corner of Section Sixteen (16), Township
(sic) Eleven (11), North and range seven (7) East and running thence South
Sixteen (16) rods and Ten (10) feet: thence East thirty (30) rods to the East
Line of the Tract Twenty Two (22) acres set off in partition of the Estate of
John R. Leach, deceased, to Patsy Leach; thence north Sixteen (16) rods to
the place of beginning, Containing three acres, more or less.
Item 4. I will, devise and bequeath the fee simple of the said real estate
described in Item 3 of this will to my children and the descendants of amy
(sic) child or children that may be dead at my decease, share and share
alike, and in equal portions, provided however that the descendents of any
child or children that may be dead at my deceas(sic), shall take only the
share of said real estate that said deceased child or children would take, if
living at my decease.
Item 5. I consitute and appoint my beloved wife, Harriet M. Pope, Executrix
of this Will.
Witness my hand and seal the 12" day of March 1910.

The foregoing instrument was signed, sealed and acknowledged by said
David Pope as his last will and TesTament (sic) in our presence, and, we the
undersigned, at his request hin (sic) his presence and the presence of each
other, have subscribed out (sic) names as Witnesses thereto this 12" day of
March 1910.

STATE OF INDIANA, SHELBY COUNTY SS
BE IT REMEMBERED, That on the 15th day of September 1917, Michael O.
Sullivan one of the Subscribing witnesses to the within and foregoing last
will and testament of David Pope late of said County, Deceased, personally
appeared before Cecil B. Collins, Clerk of the Circuit Court of Shelby
County, in the State of Indiana ,and being duly sworn by the Clerk of said
Court, upon his oath, declared and testified as follows, that is to say: that
on the 12" day of March 1910 we saw the said David Pope sign his name to the
said instrument in writing as and for his last Will and Testament and that
this deponent, at the same time, heard the said David Pope Declare the said
instrument in writing was, at the same time, at the request of the said David
Pope and with his consent attestwd (sic) and subscribed by the said Michael
O. Sullivan in the presence of said testator, and in the presence of each
other, as subscribing witnesses thereto, and that the said David Pope was, at
the time of the signing and subscribing of said instrument in writing, as
aforesaid, of full age (that is, more than twenty-one years of age) and of
sound and disposing
mi nd (sic) and memory, and not under any coercion or restraint, as the said
deponent verily believes, and as further deponent says not.

Collins, Clerk of said Court, at Shelbyville, the 15th day of September 1917.

I, Cecil B. collins (sic), Clerk of the Circuit Court of Shelby County,
Indiana, do hereby certify that the within annexed will and TesTament of
David Pope has been duly admitted to probate and duly proved by the testimony
of Michael O. Sullivan one of the subscribing witnesses thereto, that a
complete record of said Will, and of the testimony of said Michael O.
Sullivan in proof thereof, has been by me duly made and recorded in Boot 7 at
Pages 255 and 256 of the record of Wills of said County.
IN ATTESTATION WHEREOF - I have hereunto subscribed my
name and affixed the seal of said Court, at Shelbyville, this 15th Day of
