Joseph  Dungan

            The last Will and Testament of  Joseph Dungan.
            In the name of the Benevolent Father of all  I  Joseph Dungan of Shelby County State of Indiana do make and publish this my last Will and Testament.
            It is my will that my just debts be paid and I devise and bequest to my beloved Wife  Clarrisa Dungan  and  Joseph Dungan  my son my farm during their natural lives for their support and the stock and farming utensils that may be on hand at my death to my wife and at the death of my Wife and my son  Joseph Dungan that the land be sold and divided equaly[sic] between my lawful heirs.
            I make and appoint  Lewis Burker  executor of this my last will and testament I do hereby revoke all former wills by me made in testimony hereof I have hereunto set my hand and seal this 17th day of March in the year 1874.

            Signed and acknowledged by said Joseph Dungan as his last will and testament in our presence and signed by us in his presence.

            Be it remembered that on the 27th day of April 1874  Robert S. Wells one of the subscribing witnesses to the within and foregoing last will and Testament of Joseph Dungan late of said County deceased personally appeared before John Elliott Clerk of the Circuit Court of Shelby County in the State of Indiana and being duly sworn by the Clerk of said Court upon his Oath declared and testified as follows that is to say:  that on the 17th day of March 1874 he saw the said Joseph Dungan sign his name to said instrument in writing as and for his last will and testament, and that this deponent at the same home heard the said Joseph Dungan declare the said instrument in writing to be his last will and testament and that the said instrument in writing was at the same time at the request of the said Joseph Dungan and with his consent attested and subscribed by the said Robert S. Wills and B. F. McFall in the presence of said testator and in the presence of each other as subscriging witnesses thereto and that the said Joseph Dungan was at the thime of the signing and subscribing of said instrument in writing as aforesaid of full age (that is more than twenty-one years of age) and of sound and disposing mind and memory and not under any coercion or restraint as the said deponent verily believes and further deponent says not.

                    I john Elliott Clerk of the Circuit Court of Shelby County Indiana do hereby certify that the within annexed will and testament of Joseph Dungan has been duly admitted to probate and duly proved by the testiony of Robert S. Wells on e of the subscribing witnesses thhereto that a complete record of said will and of the testimony of the said Robert S Wells in proof thereof has been by me duly made and recorded in Book No 1 at pages 393 & 394 of the Records of Wills of said County.
            In attestation whereof I have hereunto subscribed my name and affixed the sial of said Court at Shelbyville this 27th day of April 1874.
