Eliza Jane McKinney
I, Eliza Jane McKinney, of Shelby County, in the State of Indiana, do
make and publish and declare this my last will and testament, hereby revoking
any and all former wills by me heretofore made.
Article I
I order and direct that all my just debts be paid as soon after my
decease as may be practible.
Article II
I further order and herby authorize Dr. W. E. Cohee, my trustee, to sell
all the real estate of which I die seized and my personal property either
together or in parcels by private or public sale, and upon such terms and
conditions as he may think fit, with power to buy in, rescind, or vary any
contract of sale and to resell without responsibility for loss, and for the
purpose aforesaid to execute all such deeds, assurances and conveyances,
which may be necessary in the premises.
Article III
I will, devise and bequeath to Abner Rice, Belle Hillman, and Mary A.
Snapp, my children, share and share alike in all my estate of which I die
seized both real and personal after the same is reduced to cash as set out in
Article II of this Will.
Article IV
I hereby nominte and appoint Dr. W. H. Cohee, executor of this my last
Will and testament.
In testimony whereof, I Eliza Jane McKinney, have hereunto set my hand
this second day of January, 1918.

This will was signed by said testator, Eliza Jane McKinney as her last
will and testament, with her mark, in the presence of us, who, in her
request, have hereunto subscribed our names as witnesses this second day of
January, 1918.

Be it remembered, That on the 23" day of September, 1919 W. H. Cohee one
of the subscribing witnesses to the within and foregoing last Will and
Testament of Eliza Jane McKinney late of said County, deceased, personally
appeared before Gordon Thurston, Clerk of the Circuit Court of Shelby County,
in the State of Indiana, and being duly sworn by the Clerk of the said Court,
upon his oath, declared and testified as follows, that is to say: That on the
Second day of Jan. 1918, he saw the said Eliza Jane McKinney sign her name to
the said instrument in writing as and for her last Will and Testament; and
that his deponent, at the same time, heard the said Eliza Jane McKinney
declare the said instrument in writing to be her last Will and Testament, and
that the said instrument in writing was, at the same time, at the request of
the said Eliza Jane McKinney and with her consent attested and subscribed by
the said W. H. Cohee and M. E. Henry in the presence of said testator and in
the presence of each other, as subscribing witnesses thereto, and that the
said Eliza Jane McKinney was, at the time of the signing and subscribing of
said instrument in writing aforesaid, of full age (that is, more than twenty
one years of age), and of sound and disposing mind and memory, and not under
any coercion or restraint as the said deponent verily believes and further
deponent says not.

I, Gordon Thurston Clerk of the Circuit Court of Shelby County, Indiana,
do hereby certify that the within annexed Will and Testament of Eliza Jane
McKinney has been duly admitted to probate, and duly proved by the testimony
of W. E. Cohee one of the subscribing witnesses thereto, that a complete
record of this Will, and of the testimony of the said W. H . Cohee in proof
thereof, has been by me duly made and recorded in Book 7 at Pages 428, 429 of
the record of Wills of said County.
In Attestation Whereof, I have hereunto subscribed my hand, and affixed
the seal of said Court, at Shelbyville, this 23rd day of Sept. 1919.
