Testament of
Elizabeth
Deitzer
I, Elizabeth Deitzer of said County and State do make and publish this my last Will and Testament revoking all former wills of whatever character in manner and form as follows to wit.
1st. I do hereby order and direct my Executor as hereinafter stated to pay and discharge all my just debts as soon as practicable after my death shall have occurred and the residue of my estate the payment of my debts and necessary funeral expenses, I will and bequeath as follows to wit.
I will and bequeath to my grand daughter Bertha Springer, Five Hundred Dollars absolutely.
After the payment of all my just debts and the bequest to said Bertha Springer I will and bequeath all the residue of my estate to my children,
Jacob H. Deitzer, Louis Deitzer and Peter Deitzer share and share alike and I direct my Executor hereinafter stated to sell all my real estate and convert the same into money, or its equivalent in good commercial paper and divide the same according to the foregoing bequest except the share willed and bequeathed to my son, Peter Deitzer as trustee for said Louis Deitzer, and it is my wish, desire and directions that said Peter Deitzer as said trustee, shall hold said Louis Deitzer share of my said estate, in trust for the use and benefit of said Louis Deitzer and for no other use or purpose whatever, and in case of the death of said Peter Deitzer or of his resignation from said trust, before the death of said Louis Deitzer, I desire wish and direct the Judge of the Shelby Circuit Court to appoint a competent and responsible person as such trustee to carry into effect the provisions of this my last Will and Testament so far as the same applies to the share bequeathed and set apart for the use and benefit of said Louis Deitzer.
I do hereby appoint and nominate my son Jacob H. Deitzer my executor to carry into effect this my last will and testament and I hereby revoke so much of any and all former wills as may be in conflict with the provisions of this will and testament or any part thereof.
In Witness whereof, I have hereunto set my hand and seal this the 21st day of August A.D. 1895.

Be it remembered that on the 27th day of November 1912,
Charles A. Tindall one of the subscribing witnesses to the within and foregoing last will and testament of
Elizabeth Deitzer late of said County, deceased, personally appeared before Otto L. Coyle Clerk of the Circuit Court of Shelby County, in the State of Indiana, and being duly sworn by the Clerk of said Court upon his oath declared and testified as follows, that is to say that on the 21st day of August 1895 he saw the said Elizabeth Deitzer sign her name to the said instrument in writing as and for her last Will and Testament and that this deponent at the same time heard the said Elizabeth Deitzer declare the said instrument in writing to be her last Will and Testament and that the said instrument in writing was at the same time at the request of the said Elizabeth Deitzer and with her consent attested and subscribed by the said Charles A. Tindall and
J. R. Messick in the presence of said testator and in the presence of each other as subscribing witnesses thereto and that the said Elizabeth Deitzer was at the time of the signing and subscribing of said instrument in writing as aforesaid of full age (that is more than twenty-one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint as the said deponent verily declares and further deponent says not.

Coyle, Clerk of the Circuit Court of Shelby County, Ind., do hereby certify that the within annexed Will and Testament of Elizabeth Deitzer has been duly admitted to probate and duly proven by the testimony of Charles A. Tindall, one of the subscribing witnesses thereto, that a complete record of said Will and of the testimony of the said Charles A. Tindall in proof thereof has been by me duly made and recorded in Book 6 at pages 225-226-227 of the record of Wills of said County.
In Attestation Whereof I have hereunto subscribed my name and affixed the seal of said Court at Shelbyville the 27th day of November 1912.
