Last  Will  and  Testament
of
Ellen  McBride,  deceased


                        I, Ellen McBride, a resident of Shelby County in the state of Indiana, do hereby make, pubish and declare this to be my last will and testament hereby revoking any and all other wills by me heretofore made.

Item 1.   I direct that as soon as possible after my decease all of my debts and funeral expenses be paid out of my estate by my executor herein after named.

Item 2.   It is my will and I hereby order and direct that as soon as possible after my decease, my executor, hereinafter named, shall cause to be erected at the head of my grave and at the graves of my deceased husband,  John McBride  and my deceased children,  Mary McBride  and  John McBride,  markers, with the proper inscriptions thereon, all of which markers to cost the aggregate not to exceed the sum of One hundred fifty dollars.

Item 3.   I give, devise and bequeath to my son,  James McBride,  the sum of Three Hundred Dollars to be paid to him in cash out of my estate.

Item 4.   I give, devise and bequeath to my daughter,  Elizabeth Shewman,  the sum of Two hundred Dollars to be paid to her in cash out of my estate.

Item 5.   I give, devise and bequeath to each of my three children, viz:  Anna Buendert,  William McBride  and  Dennis J. McBride, the sum of one hundred dollars, said sum of one hundred dollars to be paid to each of them out of my estate.

Item 6.   After the payment of all my just debts and funeral expenses as provided for in Item one above, and the cost of the markers as provided for n item two above and the bequests as provided for in items three, four and five above, I give debise and all of the residue of my estate which shall remain to my children  James McBride,  Elizabeth Shewman,  Anna Buendert,  William McBride  and  Dennis J. McBride to have and to hold as their undivide property share and share alike forever in fee simple.

Item 7.   I do hereby revoke any and all other wills by me made.

Item 8.   I do hereby constitute and appoint my son-in-law,  William Buendert,   as the Executor of this my last will and testament.

              In Witness Whereof I have hereunto set my hand and seal this 3rd day of July 1918.

              Be it remembered, that on the 8th day of October, A. D. 1919, the 3rd judicial day of the October Term of the Shelby Circuit Court in said year, come into open Court William Buendert and produces in Court an instrument in writing purporting to be the last Will and Testament of Ellen McBride, deceased, and now moves the admittance thereof to probate and record, and in proof of said Will introduces Everet E. Stroup one of the subscribing witnesses thereto, who being duly sworn by the Clerk of said Court, on oath, declare and testify as follows, that is to say:
That on the 3rd day of July 1918 he saw the said Ellen McBride sign her name to said instrument in writing as and for her last Will and Testament; and that this deponent, at the same time, heard the said Ellen McBride declare the said instrument, in writing to be her last Will and Testament, and that the said instrument in writing was, at the same time, at the request of the said Ellen McBride and with her consent attested and subscribed by the said Everet E. Stroup and James Neighbors in the presence of said testator, and in the presence of each other, as subscribing witnesses thereto, and that the said Ellen McBride was, at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age (that is, more than twenty one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint, as the said deponent verily believes and further deponent says not.

              Whereupon it is ordered, adjudged and decreed by the Court that said instrument in writing purporting to be the last Will of Ellen McBride deceased, is the last Will and Testament of Ellen McBride, deceased, and is hereby admitted to probate and record in this Court.

              I, Gordon Thurston, Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the within annexed Will and Testament of Ellen McBride has been duly admitted to probate and duly proved by the testimony of Everett E. Stroup one of the subscribing witnesses thereto, that a complete record of said Will, and of the testimony of the said Everet E. Stroup in proof thereof, has been by me duly made and recorded in Book 7 at Pages 430 & 431 of the record of Wills of said County.

              In Attestation whereof, I have hereunto subscribed my name, and affixed the seal of said Court, at Shelbyville, Indiana, this 8th day of October 1919.
