Will
of
Elvira J.
Wolf
I, Elvira J Wolf do make and publish this my last will hereby
reworking all wills by me heretofore made.
Item One, I will that all my just debts and fun (short for funeral?)
expenses be first paid.
Item Two, I hereby devise and bequeath to the surviving children of my
late husband Dr. Jacob G. Wolf viz Alma W. Six, Agnes Bennett,
and Julia Puntenney the undivided three fourths part of all my real estate the same being the
residence property now owned and occupied by me in the town of Morristown,
Shelby County, Indiana, and being particularly described in the deed executed
to me by William M Six Administration etc, and recorded in deed record 123
page 125 in the recorder's office of said county the same to be held in equal
shares by devises as tenants in common with one another and with Pamela Wolf
and Clyde Wolf to whom hereby devise and bequeath share and share alike the
remaining one fourth of said property. I also devise and bequeath to
the
parties above named the sum of eight hundred and seventy five dollars to be
divided among them in the same proportion named above for the share of above
said real estate.
I hereby direct that the executor of this will
shall as soon as convenient
after my decease execute to said devises in deed resting the title of said
property in said devises in conformity to the foregoing provision. The
taxes
that are assessed against said real estate at the time of the execution of
said deed shall be probated the Executor paying the share notably accumulated
up to the said date of said deed and the balance to be paid by the devisees.
Item Three, I hereby will and bequeath all the residue of my estate share and
share alike to my two brothers, John Cusden Robinson, and Jesse William
Robinson, and my sister Sarah Jane Hidriant except that before said division
is made my executor shall surrender to said Sarah the obligation I hold
against her evidencing the advancement of the sum of Five Hundred Dollars to
her and shall also pay to her the sum of One Hundred dollars. It is my
will
that in making said division she shall not be required to account for said
advancement now from said one hundred dollars.
I have advanced to my brother John the sum of Seven Hundred fifty dollars and
to my brother Jesse the sum of Eleven Hundred fifty dollars. I hold
their
notes evidencing said advancements. It is my will that in dividing my estate said notes be treated as
advancements and that my brother shall account for the same as such.
Item Four, I hereby nominate and appoint my brother, John C Robinson Executor
of this will. I request that he shall not be required to execute any
bond. I
give to him power to collect, compromise, or compound all claims due my
estate to sell, assign, and transfer the same according to his discretion
without applying to Court for orders or authority in reference thereto and to
sell any property not herein specifically devised either at private or public
sale, with or without notice and on such terms as his judgement approves.

This foregoing will was signed by the testator Elvira J Wolf in our presence this the 25th day of November 1910 and at her request we sign the same as witnesses thereto in her presence and in the presence of each other day and date as last above written.

Be it remembered that on the 11th day of April AD
1913, the 59th judical day of the February term of the Shelby Circuit Court in
said year, come into open Court John C. Robinson and produces in court an
instrument in writing purporting to be the last will and testament of
Elvira J Wolf are eased and now moves the admittance thereof to probate and
record and in proof of said will introduces William M Pierson the subscribing
witnesses thereto who being duly sworn by the clerk of said court on oath
declare and testify as follows that is to say that on the 25th day of November
1910 he saw the said Elvira J Wolf sign her name to said instrument in writing
as and for her last will and testament, and that the deponent at the same time,
heard the said Elvira J Wolf declares the said instrument in writing to be her
last will will and testament and that the said instrument was at the same time
at the request of the said Elvira J Wolf and with her consent attests and
subscribed by the said William H Pierson and James Fenly Hargrove in the
presence of said testator and in the presence of each other as subscribing
witnesses thereto and that the said Elvira J Wolf was at the time of the signing
andsubscribing of said instrument in writing as aforesaid of full age
and of sound and disposing mind and memory and not under any coercion or
restraint as the said deponent verily believes and further deponent says not.

Whereapon it is ordered adjudged and decreed by the court that said instrument in writing purporting to be the last will of Elvira J Wolf deceased is the last will and testament of Elvira J Wolf deceased and is hereby admitted to probate and record in the court.

Shelby County Indiana do hereby
certify that the within annexed will and testament of Elvira J Wolf has been
duly admitted to probate and duly proved by the testimony of William M
Pierson one of the subscribing witnesses thereto that with complete record of
said will and of the testimony of the said William M Pierson in proof thereof
has been by me duly made and recorded in book 6, of pages 311 of the said
wills of the said county.
In attestation whereof, I have hereinto subscribed my
name and affixed the
seal of said court of Shelbyville, Indiana the 11th day of April 1913.
