Last Will and Testament
of
George Weinants, deceased
I, George Weinants, of Shelby County, Indiana, make and publish this my last
will and testament and I hereby revoke all former wills made by me.
Item 1. -- I desire that all my just debts, including funeral expenses
and the cost of administering my estate, be paid first, and I direct that a
monument be erected at my grave and that of my wife, Elizabeth Weinants, at
the cost of $500 the same to be erected by my executor hereinafter named.
Item 2.-- I will and bequest to my sons, Russel R. Weinants and Ralph W. Weinants, the sum of $210.00 each to make them equal with my older children
to whom I gave a horse, buggy and harness when they reached the age of 21
years but if either or both of my said sons shall become of age and receive a
horse, buggy and harness before my decease then they shall not be entitled to
the said $210.00 and I also bequeath to my daughters, Ersia Pricilla Weinants
and Frances S. Weinants, the sum of $40.00 each, to make them equal with my
older daughters, to whom I gave a cow but if I shall give to my said
daughters or either of them the said sum of $40.00 before my decease, then
this item shall be void as to such as may have received the same in my
lifetime.
Item 3. -- I give and bequeath to my wife, Elizabeth Weinants, the sum
of $500, in lieu of her statutory allowance of $500.00 under the law.
Item 4. -- It is my will and I desire that my Executor, hereinafter
named shall sell and convert into cash the following described real estate
located in Shelby County, Indiana, towit: The West half of the Southwest H.
Weinanon 18, in township 11 North, in Range 7 east excepting therefrom all
that part thereof lying on the south side of Flat Rock River, the part
excepted containing 2.5 acres more or less and the part to be sold containing
77.5 acres, more or less and out of the proceeds of such sale my said
executor shall pay all the above bequests and all liabilities of my estate.
Item -- 5. I will and devise to my wife, Elizabeth Weinants, for the
term of her natural life or so long as she reamins unmarried after my death
the following described real estate located in Shelby County, Indiana, towit:
A strip of land 13 chains and 43 links in width off the entire south side of
the East half of the southeast quarter of section 12, in township 11 north,
in Range 6 east, containing 27 acres, more or less. Also Beginning at the
South West corner of the Soust West quarter of Section 7 in Township 11
North, in Range 7 East and running thence 3 chains and 86 links; thence north
12 chains and 46 links; thence west 3 chains and 86 links; and thence south
12 chains and 46 links, to the place of beginning, containint 4 acres, more
or less. Also, beginning 3 chains and 86 links East of the south west corner
of the South west quarter of Section 7 in Township 11 North, in Range 7 east,
and running thenceforth to the center of Lewis Creek; thence Easterwardly up
the center of said Creek to a point 11 chains and 86 links east of the west
line of said quarter section; thence south to the south line of said quarter
section; and thence west
86 chains to the place of beginning, containing 6.5 acres, more or less.
Also the North west quarter of the North West quarter of Section 18, in
Township 11 North, in Range 7 east, containing 40 acres, more or less, and
the fee simple thereof I will and devise to my
children, towit: George H. Weinants, Cora A. Thomas, Rosa Soudder, Paul W.
Weinants, Ursula
Pricilla Weinants, Frances S. Weinants, Ralph W. Weinants and Russell R.
Weinants, share and share alike.
Item 6. -- I will and devise and bequeath all the rest of my property,
both real and personal, share and share alike, to the said eight children
named in item 6 above.
Item 7. -- It is my desire and I hereby direct that in case any of my
children shall not abide by the provisions of this will then such as may try
to defeat the terms hereof shall take no interest in any of the property
owned by me at the time of my death and the share of such as may not abide by
the terms hereof shall go to my other children who are satisfied with the
terms hereof.
Item 8. -- I hereby appoint Louis Weinants, my brother, as Executor of
this my will to carry into effect the terms hereof.
In witness whereof I have hereunto set my hand and seal this 13th day of
August, 1910.

We, the undersigned, hereby certify that the foregoing will was signed and
acknowledged by the sid George Weinants, in our presence and we hereby
witness his said signature at his request, in hie presence and in the
presence of each other this 13th day of August, 1910.

BE IT REMEMBERED, That on the 2nd day of September 1919 Anderville Shaw
one of the subscribing witnesses to the within and foregoing last will and
testament of George Weinants late of said County, dceased, personall appeared
before Gordon Thurston, Clerk of the Circuit Court of Shelby County, in the
State of Indiana, and being duly sworn by the Clerk of said Court, upon his
oath, declared and testitifed as follows, that is to say: That on the 13th
day of August 1910 he saw the said George Weinants declare the said
instrument in writing to be his last will and testament, and that the said
instrument in writing was at the same time, at the request of the said George
Weinants and with his consent attested and subscribed by the said Anderville
Shaw, & S.B. Conover in the presence of said testator, and in the presence of
each other, as subscribing witnesses thereto, and that the said George
Weinants was, at the time of the signing and subscribing of said instrument
in writing, as aforesaid, of full age (that is, more than twenty one years of
age), and of sound and disposing mind and memory and not under any coercion
or restraint as the said deponent verily believes, and further deponent says
not.

Thurston, Clerk of said court, at Shelbyville the 2nd day of September 1919.
IN ATTESTATION WHEREOF, I have hereunto subscribed my name, and affixed

I, Gordon Thurston, Clerk of the Circuit Court of Shelby County,
Indiana, do hereby certify that the within annexed Will and testament of
George Weinants has been duly admitted to probate, and duly approved by the
testimony of Anderville Shaw one of the subscribing witnesses thereto, that a
complete record of the said will, and of the testimony of the said George
Weinants in proof thereof, has been by me duly made and recorded in Book 7 at
Pages 420, 421 and 422 of the record of wills of said County.
IN ATTESTATION WHEREOF, I have hereunto subscribed my name, and affixed the seal of said Court, at Shelbyville, this 2d day of Sept. 1919.

Election of Widow
I hereby elect to accept the provisions of the will of George Weinants
deceased, made for me, and I hereby agree to comply fully with the terms
thereof and I hereby waive my right to revoke said will.

Before me, the undersigned, a Notary Public, in and for said County and
State appea red said Elizabeth Weinants, widow of George Weinants, deceased
and acknowledg the execution of the above instrument as her free act and deed.
