Last  Will  and  Testament
of
Harrison  Jones,
deceased

18 June 1918


          I, Harrison Jones, at this time a resident of Shelby County, Indiana, being of sound and disposing mind and memory do hereby make publish and declare this to be my last will and testament, hereby revoking any former will by me made.

Item 1.  It is my will and I hereby direct my executor hereinafter named shall as soon after my death as it is practicable pay and discharge all of my just and legal debts including expense of last sickness and funeral.

Item 2.  I hereby will and direct my executor, as soon after my death as is practicable to sell and dispose of all the property, both real and personal, of which I may die the owner, to the best advantage and for the best possible price.   And I hereby will and direct that out of the proceeds of such sales my said executor shall pay and discharge any lien or liens that may exist against any real estate that I may die the owner; and it is my further will that my said executor shall, out of the proceeds of the sales of my said property pay to my son  Willie J. Jones  and my daughter  Ida E. Mann  each the sum of One Hundred dollars; and that it is my further will and I hereby direct, that after the payment of said last bequests, and the payment of all of my debts and expenses mentioned in Item 1, above and the payment of the expenses for the administering on my estate, that all the rest and residue of money so remaining shall be by my executor, paid to my daughter  Lucilla Pearl Branson,  with whom I have for four years made my home, and who has at all times treated me with parental care and affection.
A further consideration for the bequest of only one hundred dollars to my said son being that I have advanced money to him at different times.

Item 3.  I hereby nominate, constitute and appoint  Will A. Yarling the executor of this my last will and testament.

Item 4.  If any devisee herein shall in any wise attempt to set aside my will then I desire, that such devisee shall take no part of my estate.


And in witness of this my last will and testament, I have hereunto set my hand and seal this 19th day of September 1905.

In our presence and hearing this 19th day of September 1905 Harrison Jones, to us well known signed and sealed the above and foregoing instrument, and declared the same to be his last will and testament, and we, the undersigned, in his presence, and in the presence of each other and at his request, have hereunto subscribed our names as witnesses to and of said last will and testament This 19th day of September 1905.

State of Indiana, Shelby County, SS:
          In the Matter of the Probate of the Will of Harrison Jones, deceased.   Samuel P. McCrea being first duly sworn on his oath deposes and says: that he has carefully examined the instrument of writing purporting to be the last will and testament of Harrison Jones, deceased late of said county, bearing date of September 19, 1905 and this day produced for probate in the Shelby circuit Court; that he was well acquainted with A. L. Sparks and G. W. John, who appear to be the subscribing witnesses thereto and that they were both competent at the date of attesting the same so to do and that said subscribing witnesses to his personal knowledge are both dead.   That deponent further says he was well acquainted with the handwriting of said subscribing witnesses and that the signitures of said witnesses are true and genuine as he believes; that at the date aforesaid when said instrument appears to have been executed, said testator was over the age of 21 years and as affiant believes competent to devise his property, and further says not.

Will A. Yarling being first duly sworn on his oath deposes and says:
That he has carefully examined the instrument of writing purporting to be the last will and testament of Harrison Jones deceased late of said county bearing date of September 19, 1905 and this day produced for probate in the circuit court of said county before Alonzo Blair the sole judge thereof; that he was acquainted with A. L. Sparks and G. W. John who appear to be subscribing witnesses thereto and that they were both competant at the date of attesting the same so to do and that said subscribing witness to his personal knowledge are both dead. Deponent says further that he saw both said witnesses subscribe their names as witnesses to and of said last will; that he saw said testator sign his name to said last will and that he declared the same to be his last will which was done in the presence of said witnesses. That the signiture of said witnesses and of said testator are true and genuine; that at the date aforesaid when said instrument was executed said testator was over the age of 21 years and as affiant believes competent to devise his property and further says not.

          I, Gordon Thurston, Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the within annexed will and testament of Harrison Jones has been duly admitted to probate, and duly proved by the testimony of Samuel P. McCrea and Will A. Yarling witnesses concerning the death of witnesses to said will and the genuineness of signitures of said witnesses and said testator, that a complete record of said Will, and the testimony of Samuel P. McCrea and Will A. Yarling in proof thereof, has been by me duly made and recorded in Book 7 at pages 322 and 323 of the record of Wills of said County.
