I, Jacob Medsker of Shelby County, Indiana, being of sound mind and disposing memory do make and publish this my last will and testament hereby revoking all former wills made by me.
Item 1. I give and devise and bequeath to my son Noah Medsker after the payment of all my just debts and expense of administration all my property both real and personal that I may own at the time of my death.
Item 2. I nominate and appoint Chas. H. Tindall executor of this my last will and testament.
Item 3. I hereby direct the payment to Tindall & Tindall the payment of charges and fees for services done and performed for me in the making of the deeds and advise and consultation in the year 1897 and also for like services in the year 1900 and also for like services rendered in the year 1908 and 1909.
Item 4. It is my will and desire that there be no contest by any of my children or their descendants of this will as I hereby assert and declare that in the making of this will I have taken into consideration all advancements and services rendered by my children and their descendants and it is my wish that my children and their descendants shall be satisfied and content.
In testimony whereof, I have hereunto set my hand, this 15th day of Jan. 1909.

Subscribed by the said Jacob Medsker in our presence and by him declared to be his last will, and attested by us as such in his presence and in the presence of each other, this 15th. day of January 1909.

Be it remembered, that on the 15 day of April, A. D., 1916 the 29 judicial day of the Mch Term of the Shelby Circuit Court in said year, come into open Court John A. Tindall and produces in Court an instrument in writing purporting to be the last Will and Testament of Jacob Medsker, deceased, and now moves the admittance thereof to probate and record, and in proof of said will introduces Mary H. Weed the subscribing witnesses thereto, who being duly sworn by the Clerk of said Court, on oath, declare and testify as follows, that is to say: That on the 15" day of Jan. 1909 she saw the said Jacob Medsker sign his name to said instrument in writing to be his last Will and Testament, and that the said instrument in writing was, at the same time, at the request of the said Jacob Medsker and with his consent attested and subscribed by the said Mary H. Weed and Chas. H. Tindall in the presence of said testator, and in the presence of each other, as subscribing witnesses thereto, and that the said Jacob Medsker was, at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age (that is, more than twenty-one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint, as the said deponent verily believes and further deponent says not.

Sworn to and subscribed by the said Mary H. Weed before me Cecil B. Collins Clerk of said Court, at Shelbyville Indiana, the 15" day of April 1916.

Whereupon it is ordered, adjudged and decreed by the Court that said instrument in writing purporting to be the last Will of Jacob Medsker deceased, is the last Will and Testament of Jacob Medsker deceased, and is hereby admitted to probate and record in this Court.

I, Cecil B. Collins, Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the within annexed Will and Testament of Jacob Medsker, has been duly admitted to probate and duly proved by the testimony of Mary H. Weed one of the subscribing witnesses thereto, that a complete record of said Will, and of the testimony of the said Mary H. Weed in proof thereof, has been by me duly made and recorded in Book 7 of Pages 109 & 110 of the record of Wills of said County.
IN ATTESTATION WHEREOF, I have hereunto subscribed my name, and affixed the seal of said Court, at Shelbyville Indiana, this 15" day of April 1916.
