Last  Will  and  Testament
of

James  Campbell


May 8, 1837

          I, James Campbell  of the county of Shelby and State of Indiana, do make and publish this my last will and testament, hereby revoking and making void all former wills by me at any time heretofore made--

First, I direct that my body be decently interred, and that funeral be conducted in a manner corresponding with my estate and situation in life; and as to such worldly estate as it has pleased God to entrust with me with I dispose of the same in the following manner to wit I direct that my just debts and funeral expenses be paid as soon after my decease as possible, out of the first moneys that shall come to the hands of my executor from any portion of my personal estate - As it respects my Real estate, my will is , that each of my children  China Campbell,  now  China Myers,  Wm H. Walker  my son-in low, who married my Daughter  Polly,  who is now deceased,  Alfred Campbell,  Nelson Campbell,  Harriet Campbell,  and  Washington Campbell,  be portioned in the following manner, that is to say - my sons  Alfred, Nelson shall have that portion of my real estate as this day deeded to them, whenever they shall have arrived to the age of twenty one years, or as soon as they shall become married, and until such time or times the proceed of the land this day deeded to them shall be appropriated to the raising and educating of them in common with the rest of my children in a state of minority and during the same.  My son  Washington Campbell, my will is he at the death or marriage of my Beloved  Martha Campbell,  shall have that portion of real estate, this day deeded to him when ever he shall arrive to the age of twenty one years or become married. But until death or marriage of his said mother and until having arrived at the age of twenty one years naming as aforesaid the proceed of the said land deeded to him shall be appropriated to the raising and educating of him the said  Washington as with the rest of my children during their state of minority.  My will is that my daughter  Harriet shall have that portion of my real estate today deeded to her, when she shall have arrived at the age of twenty one years, or becomes married and until such time the proceeds of the land deeded to her as aforesaid shall be appropriated to the raising and educating of her the said Harriet in common with the rest of my children in a state of minority and during the same ---- My will is that my son-in-law  Wm H. Walker  shall have the full right of title in fee simple of the certain quarter section of land sold to me by  James McIntire  who on the day of said sale made and executed to me his title bond which title bond I have today my right title interest and claim to my son-in-law Wm H. Walker.  It being his full portion of my real estate and my will is that said deed be made to Wm H. Walker instead of  James Campbell

__ And I further direct that my other son-in-law - Robert Myers  who married my daughter  China Campbell  have that other portion of my real estate ( viz) a part of the South West quarter of Section Twenty Seven in Township 11 N of Range 6E heretofore deeded to him the said  Robert Myers.  It being his full portion of my real estate.  I also direct that my beloved wife Martha have full management of all my real estate, as will in the future belong to my children or their heirs or assigns viz to Alfred, Nelson, Harriet, and Washington, and jointly to appropriate the same to the raising and educating them and to have her own needs and comforts as it respects my personal estate and direct that, such a part of it as my executor and beloved wife Martha shall think necessary shall be sold at public auction after the same shall have been valued and appraised by two judicious neighbors and so much of the avails of the same as is necessary to be appropriated to the liquidating my just debts and the balance (if any) my beloved wife to have for her necessary needs.  I also hereby make and ordain my worthy and esteemed friend  Benjamin Sanders,  executor of this my last will and testament and I further direct and appoint my beloved wife Martha Campbell to have the guardianship of my children during their state of minority, so long as she shall continue solo and unmarried, and, in case of her death or marriage during the minority of such my children, then I direct and appoint my esteemed friend  Benjamin Sanders shall have the tuition and guardianship of them during such their minority. And I earnestly entrust them utmost care and attention respectively, in and about the education and morals of my said children.

In witness, whereof, I , James Campbell, the testator have hereunto set my hand and seal this eighth day of May in the year of our Lord eighteen hundred and thirty seven.
