Last  Will  and  Testament
of

James  J.  Curtis


            I  James J. Curtis, of Shelby County and State of Indiana, being of sound and disposing mind, do hereby make, publish and declare this to be my Last Will and Testament as follows.
            First,  I hereby revoke, cancel and annul all former Wills, Testaments and codicils by me at any time made.
            Second,  In account of adjustments of the rights of my children this day made and heretofore made, covering all of items and my Grandchildren, and the provisions made for them, and in account of the liabilities and undertakings assumed by  James B. Curtis,  I hereby give, devise and bequeath to James B. Curtis of the City, County and State of New York all of my property, real and personal of every kind and description wherever situated.
            Third,  I hereby nominate and appoint James B. Curtis of the City, County and State of New York as executor of my estate and direct that he shall act without Bond.
            In Witness Whereof, I have hereunto, subscribed my name and executed this Will in typewritten form to be witnessed in due form of law this 2nd day of November 1911.

            We, the undersigned do hereby certify that the foregoing instrument in writing was signed sealed and declared by James J. Curtis to be his last Will and Testament in our presence and at his request.     We now sign as witnesses thereto in his presence and in the presence of each this the 23rd day of November, 1911.

            Be it remembered that on the 29th day of July 1912 Will W. Curtis and Everet E. Stroup the subscribing witnesses to the written and foregoing last Will and Testament of James J. Curtis late of said County deceased personally appeared before Mr. Otis L. Coyle Clerk from Circuit Court of Shelby County in the State of Indiana and being duly sworn by the Clerk of said Court upon their oath declared and testified as follows that is to say That on the 23rd day of November 1911 they saw the said James J. Curtis sign his name to the said instrument in writing as and for his last Will and Testament and than these deponents at the same time heard the said James J. Curtis declare the said instrument in writing was at the same time at the request of the said James J. Curtis and with his comment attested and subscribed by the same William W. Curtis and Everet E. Stroup in the presence of said testator and in the presence of each other as subscribing witnesses thereto and that the said James J. Curtis was at the time of the signing and subscribing of said instrument in writing as aforesaid of full age (that is more than twenty one years of age) and of sound and disposing mind and memory and not under any coercion or restraint as the said deponents verily believe and further deponent say not.

            I Otto L. Coyle Clerk of the Circuit Court of Shelby County Indiana do hereby certify that the within annexed Will and Testament of James J. Curtis has been duly admitted to probate and dully proved by the testimony of the said Wm W. Curtis and Everet E. Stroup is proof thereof has been by me duly made and recorded in Book 6 at pages 164-165-166 of the record of Will of said County.

            In Attestation Whereof I have hereunto subscribed my name and affixed the seal of said Court at Shelbyville this 29th day of July 1912.
