Will  of  Thomas  Jenkins

Will Book 1    pages 267-269

            In the name of the benevolent Father of all  I  Thomas Jenkins of Shelby County Indiana do make and publishthis my last Will and Testament.

            Item 1st.    I give and devise to my beloved wife  Mary Ann  in lieu of her interest in my lands, te farm on which we now reside situate in Liberty Township Shelby County Indiana.  Containing about One hundred and thirty Acres during her natural life  and all the stock, household goods, furniture , provisions and other goods and chattels which may be thereon at the time of my decease during her natural life as aforesaid.  She however selling so much thereof as may be sufficient to pay my just debts and also to realize an amount sufficient to pay my son  James  one hundred and thirty five dollars and my daughter  Susan E. Huffman  One hundred and thirty five dollars and my son  George L  three hundred dollars to equalize advances to my other sons and daughters  viz  Elizabeth Ann Crigler (deceased),  Joseph Jinkins (deceased),  Robert Jinkins (deceased),  Amanda Jane Darnell John L. Jinkins.  At the death of my said wife the real estate aforesaid I give and devise to my sons daughters and Grandchildren,  viz  John L. Jinkins,  James A Jinkins,  George L Jenkins.  Susan E Huffman  wife of  Gideon Huffman  and  Richard R Crigler,  a grandchild and son of the said Elizabeth Ann Crigler (deceased) And  Everett E  and  Annetta H Jinkins,  grandchildren and children of the said Joseph Jenkins (deceased) and their heirs if however my said grandchild Richard R. Crigler should died before arriving at the age of twenty one years the the[sic] share of said property above devised to him is hereby devised to my said sons daughters and Grandchildren herein mentioned and their heirs and in case the death of either of said grandchildren Everett E and Annetta H Jenkins, before arriving at the age of twenty one years without issue or children then living then the share of such deceased grand children is hereby devised to my said sons and daughters herein mentioned and their heirs.  If my said wife should not survive me then I devise and bequeathe the property aforesaid to my said sons daughters and grand children subject to the condition and limitations herein mentioned and their heirs forever

            Item 2nd.    I hereby nominate and appoint  William Miller  of Liberty Township Shelby County Executor of this my Last Will and Testament, hereby authorizing and empowering him to compromise, adjust release and discharge in such manner as he may deem proper, the debts and claims due me.  I do also authorize and empower if it shall be necessary in order to pay my debts to sell by private sale or in such manner upon such terms of credit or otherwise as he may think proper all or any part of my Real Estate and deeds to purchase and to execute acknowledge and deliver in fee simple.

            I do hereby revoke all former wills by me made.

                                            Be it remembered that on the Seventh day of February AD 1870  Robert Worland one of the subscribing witnesses to the within and foregoing last Will and Testament of Thomas Jinkins late of said County, deceased, personally appeared before  J G Wolf Clerk of the Court of Common Pleas of Shelby County in the State of Indiana, and being duly swornby the clerk of said Court, upon his oath declared and testified as follows   that is to say, that on the 23" day of December AD 1870 he saw the said Thomas Jenkins sign his name to said instrument in writing as and for his last will and Testament and that this deponent as the same time heard the said Thomas Jenkins declare the said instrument in writing to be his last Will and Testament, and that the said instrument in writing was at the same time at the request of the said Thomas Jinkins and with his consent attested and subscribed by the said Robert Worland and James H Fisher in the presence of said testator and in the presence of each other as subscribing witnesses thereto.  And the at the said Testator was at the time of the signing and subscribing of said instrument in writing as aforesaid, of full age, (that is more than twenty one years of age) and of sound and disposing mind and memory, and under any coercion or restraint, as the said deponent verily believes.  And further deponent says not.

                        I  J G Wolf clerk of the Court of Common Pleas of Shelby County Indiana do hereby certify that the within annexed will and Testament of Thomas Jinkins has been duly admitted to Probate and duly proved by the testimony of Robert Worland one of the subscribing witnesses there, that a complete Record of said will and of the testimony of the said Robert Worland in proof thereof has been by me duly made and recorded in Book 1 at pages 267, 268 and 269 of the Records of Wills of said County.
