Last Will and Testament
of
Jesse  Shaw


                     I, Jesse Shaw of Shelby County, State of Indiana, make and publish this my last Will and Testament and I hereby revoke all former Will made by me.

          Item One  I direct that all my just debts be paid in full.

          Item Two  I will devise and bequeath to my wife Esther Shaw the undivided one third of all real estate owned by me at my decease wherever located in fee simple.  I give my said wife the sum of $500.00 in cash in lieu of the Statutory rights. 

          Item Three  I give and devise to my son Anderville Shaw the undivided four Twenty firsts (4/21) of all the real estate owned by me at my decease, wherever located, in fee simple.

          Item Four  I will and devise to my son  Thomas H. Shaw and Hattie Shaw, his wife as tenants by the entireties, the undivided two twenty firsts (2/21) of all the real estate owned by me at my decease wherever located in fee simple, but they shall pay to my estate the sum of $400.00 which I make a charge against and a lien upon said real estate, herein devised to them.

The lien of $400.00 created by Item Four of this will against the property devised to Thomas H. Shaw and Hattie Shaw has been fully paid and satisfied this Oct. 10th 1913. Anderville Shaw, Executor of the Will of Jesse Shaw, deceased. 

          Item Five  I will and devise to my son, William R. Shaw, and to my daughter  Martha A. Tucker,   Mary A. Phillips  and  Gertrude Luther each the undivided two twenty firsts of all the real estate owned by me at the time of my decease, wherever located in fee simple.

          Item Six  I give and bequeath to the following named persons (my said wife and children) all the residue of my property of every Kind in the following proportions towit:
To Ester Shaw my wife, one third
To Martha A. Tucker, my daughter, 2/21 
To Anderville Shaw my son 4/21
To Mary A. Phillips, my daughter 2/21
To Thomas H. Shaw, my son 2/21
To Gertrude Luther my daughter 2/21
          Item Seven  I hereby appoint my said son Anderville Shaw executor of this Will to carry out the provisions hereof. 
          In Witness Whereof I have hereunto set my hand and seal this 15th day of March 1913.

          Be It Remembered, That on the 2" day of April A.D. 1913 the 51st Judicial day of the February Term of the Shelby Circuit Court in said year, come into open Court John Burk and produces in Court an instrument in writing purporting to be the last Will and Testament of Jesse Shaw deceased and now moves the admittance thereof to probate and record and in proof of said Will introduces John Burk the subscribing witnesses thereto who being duly sworn by the Clerk of said Court on oath declare and testify as follows that is to say, That on the 15" day of March, 1913 he saw the said Jesse Shaw sign his name to said instrument in writing as and for his last Will and Testament and that the deponent, at the same time heard the said Jesse Shaw declare the said instrument in writing to be his last Will and Testament and that the said instrument in writing was at the same time at the request of the said Jesse Shaw and with his consent attested and subscribed by the said John Burk and Esther Shaw and James Shaw in the presence of said testator and in the presence of each other, as subscribing witnesses thereto and that the said Jesse Shaw was at the time of the signing and subscribing of said instrument in writing, as aforesaid of full age (that is more than twenty one years of age) and of sound and disposing mind and memory and not under any coercion or restraint, as the said deponent verily believes and further deponent says not.

          Whereupon it is ordered adjudged and decreed by the Court that said instrument in writing purporting to be the last Will of Jesse Shaw deceased is the last Will and Testament of Jesse Shaw deceased and is hereby admitted to probate and record in this Court.

          I, Otto L. Coyle Clerk of the Circuit Court of Shelby County, Indiana do hereby certify that the within annexed Will and Testament of Jesse Shaw has been duly admitted to probate and duly proved by the testimony of John Burk one of the subscribing witnesses thereto that a complete record of said Will and of the Testimony of the said John Burk in proof thereof has been by me duly made and recorded in Book 6 at pages 291-292-293 and 294 of the record of Wills of said County.

          In Attestation Whereof I have thereunto subscribed my name and affixed the seal of said Court at Shelbyville, Indiana this 2" day of April 1913.
