The  Last  Will  and  Testament  of
John  Clark,  deceased


                    Be it remembered that on the Eighteenth day of March the year of our Lord one thousand Eight hundred and twenty Nine the following Last will and Testament of  John Clark  deceased was filed in the office of the clerk of the Shelby Circuit Court  Towit:

                    In the name of God amen.  I John Clark of Shelby County and State of Indiana being very Sick and weak in Body but in perfect mind and memory thanks be given unto God  Calling unto mind the mortality of my Body Knowing that it is appointed for all men once to die.  Do make and ordain this my Last will and testament, that is to say principally an[sic] first of all I give and recommend to the Earth to be Buried in decent Christian Like Buriel[sic] at the discretion of my Executors, nothing doubting but at the general Rezerrection I shall Receive the Same again by the mighty power of God.  And as touching Such worldly Estate wherewith it has pleased God to Bless me in this Life --- I give demise an[sic] dispose of the Same in the following manner an form.  First I give and Bequeath to my Sun  Elexander Clarke  one Bright Bay horse --- Further more I give an Bequeath to my daughter  Margaret  five dollars.  And also I do give to my Daughter  Sary  five dollars --- And further more I give and Bequeath to my son John five dollars.  And I also Request that my Sun John Should be bound to Sum good trade as Soon as convenient.
                    And out of the rest of my Estate firs[sic] to pay all my Just debts, then the rest of my Estate to Mary my wife and the fore youngest Children  Licady  An  Indiana  An  Jesse  an  Joseph Culberson  for them to support on during my wife being my widow.  And further more I do Requeste for my Executors to Rente out my farm for the fore years which I hold my Leas for and that yearly to the Bast advantage for the Support of my wife and the fore youngest Children ---

Ray Should be my Executors to Have authorit and full power to act on and with my Estate as they think best.
                    As Witnesseth whereof I have Set my hand and afixt my Seal this the 25th day of February in the year of our Lord 1824.

                    And Be it further Remembered that at the time of the filing the aforesaid Last will and Testament of John Clark deceased,  Personally appeared before me  Hiram Alldredge  Clerk of the Shelby Circuit Court,  James Wray and  Bartlett Perry the Subscribing witnesses to the aforesaid Last will and Testament of the Said John Clark deceased.  And took an oath that they Saw John Clark, Sign, Seal, Publish and declare the writing to which his name is annexed, as and for his Last will and testament that they Believed he was of Perfect Sence and memory at the Execution thereof.  And that they Sign their names as Witness thereto in his Presence.



                    And Be it further Remembered that on the Eighteenth day of March in the year of our Lord one thousand Eight hundred and twenty nine, the following Letters Testamentary was issued by me Hiram Alldredge Clerk of the shelby Circuit Court Towit ~ ~
                    State of Indiana, Shelby County, ss.
To all To whom these Presents, Shall Come greeting ---- Know Ye that at Shelbyville on the Eighteenth day of March in the year of our Lord one thousand Eight hundred and twenty nine ---- Before me Hiram Alldredge Clerk of the Shelby Circuit Court the Last will and Testament of JOhn Clark deceased (copy is hereunto annexed) was Proven and is now approved and allowed by me, And the Said deceased Having whilst Living and at the time of his death, goods chattles and Credits within this State, By means whereof the Proving and Registering Said will

And the granting Administration of all and Singular the Said goods Chattles and Credits, Doth appertain unto me in the vacation, by the Statute of the State of Indiana in Such Case made and Provided ---   The administration of all and Singular the goods chattels and Credits of the Said deceased or in any concerning the Said will is granted unto.  James Wray and Hutson Ray Executors of the Said Last will and testament of John Clark deceased, and the Said Executors are hereby Required to make a true and perfect Inventory, of all the Said goods chattels and Credits --- as also a Just account thereof, when thereunto Required ---
                    And the Said James Wray and Hutson Ray having Entered into bonds according to Law ---
                                        In Testimony whereof I have hereunto Set my hand and affixed the Sial of our Said Court at Shelbyville the 18th day of March AD. 1829 ----

                    Whereupon the Said James Wray and Hutson Ray took an oath that the instrument to which John Clarks name is annexed, Contains the true Last will and Testament of the Said John Clark deceased So far as they Knew or believed.  And that they would well and truly Execute and perform the Same by paying his debts and the Legacies Contained in Said will So far as goods Chattles and Credits will Extend and the Law Require them.  And that they would make a true and perfect Inventory, of all the Said goods chattles and Credits, as also a Just account there of when thereunto Required ----

                    And Be it further Remembered that afterwards towit, on the 14th day of April in the year of our Lord one thousand Eight hundred and twenty nine, the following Inventory was filed in the office of the Clerk of the Shelby Circuit Court towit ----
                    "Inventory of the personal Estate of John Clark deceased ---- By James Wary and Hutson Ray Executors, And appraised by Benjamin Bass and John Nail, free holders & Sworn as the Law direct

                                        This day personally appeared before me a Justice of the Peace in and for Said County,  Benjamin Bass  and  John Nail  being freeholders in the neighbourhoods and being Called on by James Wray and Hutson Ray the Executors of John Clark deceased was duly Sworn as the Law directs to value the goods and chattles of the Said deceased.
Given under my hands at my office this 19th day of March 1829.

                                        Be it Remembered that on the 14th day of April in the year 1829.  Personally appeared before me  A M Smith  one of the Justice of the Peace in and for Said County, James Wray and Hutson Wray the foregoing Executors of the Last will and testament of John Clark Deceased, who being duly Sworn deposeth and Saith that the foregoing is a Correct Inventory, of the personal Estate of the Said John Clark deceased So far as the Same have Come to their knowledge  And also came Henry Bass and John Nail the appraisers of the Said Estate, who being duly Sworn do Say that the foregoing Inventory is a true Copy of the appraisement made by them of the property Exhibited to them by the Executors of the Last will and Testament of John Clark deceased --- And further saith not

                    Be it Remembered that on the thrid day of November in the year of our Lord one thousand Eight hundred and twenty and twenty nine, the following further Inventory was filed in the Office of the clerk of the Probate Court of Shelby County towit:  "November 3rd 1829.  This is to certify that this is a true List of a Further Inventory of a few articles, towit it Being apart of the Property of John Clark Decd

John Clark Dec.d         Further Sale Bill

Be it remembered that on the 5th day of January in the year 1830 the following Sale Bill was filed in the Probate Court of Shelby County, January 5th, 1830.  This is to certify that this is a true List of the amount of the present Sale of the Property of John Clark decd which was advertissed according to Law, and sold on the 14th day of November 1829 by us James Wray and Hutson Ray as Executors of said Estate given under my hand the day and date above written.
