Last Will and Testament of
John Morgan Kennedy
I, John Morgan Kennedy,
Sr., of Shelby County, Indiana, do make and publish this my last Will and
Testament.
Item 1. It is my last will that after my death all of my just debts
and funeral expenses be fully paid out of my Estate.
Item 2. I will and bequeath to my beloved wife, Thankful Ann
Kennedy,
as her sole and absolute property all of my personal property of every kind and
description what ever, including notes and chores in action.
In Witness Whereof I hereunto set my hand and seal this 18th day of January 1910.

Be it remembered, that on the 24th day of August 1911, Elmer
Bassett one of the subscribing witnesses to the within and foregoing last Will
and Testament of John M. Kennedy, Sr., late of said County, deceased, personally
appeared before Otto L. Coyle, Clerk of the Circuit Court of Shelby County, in
the State of Indiana, and being duly sworn by the Clerk of said Court, upon his
oath, declared and testified as follows, that is to say: That on the 18th day of January, 1910 he saw the
said John M. Kennedy, Sr., sign his name to the said instrument in writing as
and for his last Will and Testament; and that this deponent at the same time,
heard the said John M. Kennedy and with his consent attested and subscribed by
the said Elmer Bassett and Albert W. Kennedy in the presence of said testator,
and in the presence of each other, as subscribing witnesses thereto, and that
the said John M. Kennedy, Sr., was, at the time of the signing and subscribing
of said instrument in writing, as aforesaid, of full age, (that is, more than 21
years of age) and of sound and disposing mind and memory, and not under any
coercion or restraint as the said deponent verily believes and further deponent
says not.

I, Otto L. Coyle, Clerk of the Circuit Court of Shelby County, Indiana,
do hereby certify that the within annexed Will and Testament of John M. Kennedy,
Sr., has been duly admitted to probate, and duly proved by the testimony of
Elmer Bassett one of the subscribing witnesses thereto, that a complete record
of said will, and the testimony of the said Elmer Bassett in proof thereof, has
been by me duly made and recorded in Book 6 at pages 50 & 51 of the Record
of Wills of said County.

I, Thankful Ann Kennedy, widow of John M. Kennedy deceased, do hereby relinquish and renounce all right, claim and preference which I may have to administer upon the Estate of said decedent or to serve as Executor of the Last Will of said decedent and request that Thomas B. Kennedy be appointed as executor of the last Will of said decedent.
