Last  Will  and  Testament
of
John  J. Norvell

I,  John Norvell,  being of sound mind and disposing memory, do hereby make this my last will and testament hereby revoking any and all other wills by me heretofore made.

Item 1.  It is my will, that all my just debts and funeral expenses be paid out of my personal property.

Item 2.  I hereby give, devise and bequeath to my beloved wife  Juda Norvell  all of my personal property of which I may die seized as her individual property forever.  I also give and devise to my said wife ~ Juda Norell all of the real estate of which I may die seized of whatsoever value to have and to hold during the time of her natural life or while she remains my widow.  But in case of her re-marriage she shall only be entitled to her dower right, or an one third interest in my estate as the law now provides.

Item 3.  At the death or remarriage of my said wife it is my will, that my son  Frank P. Norvell  and my daughters  Luella Mann,  Hattie Oldham,  and  Ida Long, shall become sole heirs to my remaining property both real and personal after the payment of all just debts against my said estate, each heir herein named.

Item 4.  I also will that should Luella Mann die without issue, her share of my estate shall revert to the remaining heirs, Frank P. Norvell and Ida Long or their children.

Item 4 [5].  I hereby constitute and appoint my said wife Juda Norvell as executrix of this my last will and testament.

In witness thereof I have hereunto set my hand and seal this nineteenth day of August 1909.

Signed, sealed and acknowledged by the said John J. Norvell as his last will and testament and in our presence and signed by us as witnesses thereto at his own request, in his presence and in the presence of each other.

STATE OF INDIANA, Shelby County, SS:
          Be it remembered that on the 17th day of February, A.D. 1916. the 40th judicial day of the January term of the Shelby circuit court in said year, come into open Court [A--] H. Oldham and produces in Court an instrument in writing purporting to be the last Will and Testament of John J. Norvell, deceased, and now moves the admittance thereof to probate and record, and in proof of said Will introduces Thomas B. Carey one of the subscribing witnesses thereto, who being duly sworn by the Clerk of said Court, on oath, declare and testify as follows, that is to say: That on the 19th day of August 1909 he saw the said John J. Norvell sign his name to said instrument in writing as and for his last Will and Testament and that this deponent, at the same time, heard the said John J. Norvell declare the said instrument in writing to be his last Will and Testament, and that the said instrument in writing was, at same time, at the request of the said John J. Norvell and with his consent attested and subscribed by the said Thomas B. Carey and J. S. Nigh

in the presence of said testator, and in the presence of each other, as subscribing witness thereto, and that the said John J. Norvell was, at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age (that is, more than twenty-one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint, as the said deponent verily believes, and further deponent says not.

Whereupon it is ordered, adjudged and decreed by the Court that said instrument in writing purporting to be the last Will of John J. Norvell deceased, is the last Will and Testament of John J. Norvell deceased, and is hereby admitted to probate and record in this Court.

STATE OF INDIANA, Shelby County, SS:
          I, Cecil B. Collins Clerk of the circuit court of Shelby County, Indiana, do hereby certify that the within annexed Will and Testament of John J. Norvell has been duly admitted to probate, and duly proved by the testimony of Thomas B. Carey one of the subscribing witnesses thereto, that a complete record of said Will, and of the testimony of the said Thomas B. Carey in proof thereof, has been by me duly made and recorded in book 7 at pages 97-98 of the record of Wills of said County.

          IN  ATTESTATION  WHEREOF, I have hereunto subscribed my name, and affixed the seal of said Court, at Shelbyville Indiana, this 17 day of February 1916.

ELECTION  OF  WIDOW  TO  TAKE  UNDER  THE  WILL  OF  DECEDENT.


I, the undersigned, widow of John J. Norvell, deceased, late of Shelby County, Indiana, and whose last will and testament has been duly admitted to probate and record in the Shelby Circuit Court of said County and State, hereby elect to accept the provisions made by said will in my favor in lieu of my rights and interest as such widow under the statutes of descent in and to the Estate of my said husband.

State of Indiana, Shelby County, SS:
          Before me the undersigned a Notary Public in and for said County and State on this 25" day of February 1916 personally appeared the above named Juda Norvell and acknowledged the execution of the above and foregoing acceptance of the terms and provisions of the last will and testament of her late husband, John J. Norvell, deceased, to be her free and voluntary act and deed for the purposes therein mentioned.

          In witness whereof I Have hereunto set my hand and Notarial seal this 25 day of Feby 1916.
